Everyone Rests

Defense Rests.
Prosecution Rests.

Link to article in Mercury News on today's testimony:

Closing arguments will be be Monday, July 13th, and then it will be turned over to the jury.
No court tomorrow.

Today was not the bloodbath for ayres that yesterday was. I don't know if I'd call it a bad day for the prosecution, but it was definitely neutral-ish at best.

The defense has spent the last day ramping up ayres' "memory problem" which was almost flawless, until the very moment that the cross examination began, and then for a brief moment in the later afternoon, when the stars must have come into alignment, and his memory was improved a bit, co-incidentally, it was at about the same time that the re-direct from the defense took place.

We'll have more later, as we digest the day. Nothing, overwhelmingly stunning from either perspective, i think...

I looked directly into the eyes of the beast while he lied about never molesting children, never taking any actions for his own pleasure, or to stimulate pleasure in children. It felt like a very personal lie.

  1. It's simple. Physical exams are NEVER given by psychiatrists. That's it. No excuses about "bet-wetting" problems, which if AssAyres thought was due to a urological problem was beyond his scope and ability in diagnosing. What a complete fraud, not mention pedophile. I'm angry with physicians at Peninsula Psychiatric Associates. This was "tight" group and I assure you, gossip was their stock in trade. Yes, I'm one of those insiders, that knows this group and frankly, I find their cowardice more egregious than the conduct of Ayres. I had to vent, thanks and hopefully there will be a quick guilty verdict on Monday.

  2. Welcome to the blog Susan, thanks for posting. Chime in any time!

We're hoping for guilty too. Quick would be nice, but slow will work too.

  3. Excuse me, but any licensed medical doctor, including Ayres when he was licensed, has the right to give a patient physical examination.

The question of whether any MD went beyond his right to give a physical exam into the realm of a violation of the standard of care (giving rise to civil liability or loss of medical license) or (in even more egregious cases) criminal liability is an entirely separate issue.

This jury, and only this jury, will decide if Ayres is a child molester, but that conclusion does NOT automatically follow from the fact that he gave some patients gentile examinations.

  4. Anon, you're correct Ayres had a medical license, however, he is bound to act within the course and scope of his speciality, which is psychiatry. He was not "moon-lighting" in the emergency department or as a general practitioner, who had need to conduct physical exams. Therefore Ayres actions, in conducting physical examinations was morally and ethically repugnant, not to mention he was practicing outside standard medical guidelines.

Correct, as best I can tell, as long as it is for legitimate medical purposes. ayres' was not doing "exams" for legitimate medical purposes.

It is an entirely separate issue from WHAT exactly?

This is an overly simplistic statement, and is not correct from a "legal" perspective.

    And it's spelled "genital"

Although, I CAN state with almost certainly that ayres did do gentile "examinations", since I'm very likely the decendant of non-Isralite tribes somewhere back in my ancestry.

  6. We also know that Ayres molested a high number of boys from Jewish families, including David Gross, the son of pediatrician Dr. Sheldon Gross. David Gross has commented on this site about Ayres guilt.

  7. Hey, Anonymous. It's genital, not gentile. Kind of an amusing slip of the pen.

  8. I could see a psychiatrist doing a physical exam, as far as listening to the heart taking blood pressure, things like that if he was going to prescribe some type of pysch meds. It seems to me that anything else is beyond the scope of license.

It makes me sick and angry how, because of his own perversions and control issues, he hurt so many lives, not only then, but now!

Regardless of his age and infirmity, I hope that he is found guilty and confined to some prison hospital to live out his days for what he is done. There is no exuse.

  9. I have heard that everyone in prison is "innocent" and all were framed.

Sounds like Dr. Ayres will fit right in.

  10. I think the comment above forgot the word "exam" in this case has been substituted for fondling, masterbation, and other violations that are not included in any exam, child nor adult!

No doctor should have the right to examine a child without the written consent of the parent and to be fully told what the exam consists of.

If exams where so important to Ayres, as he claims, and it was for the best interest of the child he would have had a chaperone.

It's as if he was saying I give below the standard of care to my female patients because I didn't give them an exam. If an exam was best for everyone he would have done them on females.

But like a true pedophile he had no interest in females so they were not worthy of his caring nature in giving an exam, not worth hiring a chaperone! Who cares if a female had an undetected genital problem or poison oak or rash.....as a female you go elsewhere.

Yeah right, he only wanted the boys! It had nothing at all to do with an "exam" by a doctor.

He had two standards of practice one for males and one for females.

  11. Just want to say what a great job you're doing covering this story...a Shakespearean tragedy of epic proportions. Unfortunately, there is no room in my heart for compassion for the central character. He is, truly, a monster.

He has been asked by a colleague, "How do you live with yourself?" He can't answer that, because, as is ever more evident, he is a sociopath, hence the question has no meaning to him. However, I would like to know how those who support him -- in any way -- live with themselves.

  12. Thanks for your support, Lucie4, Patient, Susan, and everyone!

It's very helpful while we're all facing the brunt of this stress.
