The characters in this story are utterly fictional, and have absolutely no relation to real characters, whether they should be living or dead.

The Setting: A courtroom in Sempervirens City, California

[Sound Effects]: The sound dies down as a court official stands up to address the courtroom.

[Clerk]: Line 34 in the matter of Billy Schwein

[Stage Direction]: Prosecutor McDermott moves to stand at the table. Defense Attorney Addle Gehirnberg moves to the defendant's stand, and defendant Billy Schwein, the once famed head of the Children's Mental Health Association, and who now stands accused of molesting the children entrusted to him, begins to move from the back of the courtroom to the defendant's stand. The light glints off of his shiny new walker, and Billy grips the handles in an attempt to work in a well-worn look and feel. He looks curiously at the relatively un-scuffed feet of the walker, and wonders if there's something that he can do to make it glide across the floor, rather than scrape and hop on the rubberized feet.
[Sound Effects]: SQUEEL, SCRAAAAAPE,CHIRP

[Moira McDermott]: Moira McDermott for the people your honor.

[Addle Gehirnberg]: Good morning your honor.
[Stage Direction]: Addle preens and primps, making no visible changes to his appearance, and then fumbles out some unintelligible words of measure about being in the presence of the judge.

[The Honorable Sidney Lumet]: Mr Gehirnberg has filed a motion to continue the trial date and the district attorney has filed an opposition; we have your written statements, is there anything else you'd like to add Mr. Gehirnberg?

[Stage Direction]: Addle fumbles with paperwork, and um's and ah's his way through a few false starts at his preamble.
[Addle Gehirnberg]: I, I, I do your honor.
[Stage Direction]: Addle proceeds to mumble and speechify about a myriad of unrelated incidentals working up to his attempt to explain why he has not been preparing for the Schwein trial for the last few weeks since he closed his arguments in the trial of the famous music producer Razzle Sparkle, while the jury was interminably debating the case. (Or for the two years since his client, Mr. Schwein was arrested, for that matter...)
[Addle Gehirnberg]: First of all, uh, with uh, respect to the uh, some of the uh, things that uh I uh feel uh now should have perhaps been done uh earlier.

[Stage Direction]: Addle drones on for a bit, while preparing to deliver a convoluted string of dates in an attempt to show what he's been saying all along: that he really isn't that good at anticipating the duration of his own defense presentation.
[Addle Gehirnberg]: As of July 24th, 2008 , I had already as of May 22nd 2008, been assigned to a trial in Tinsel City...
[Stage Direction]: Addle pauses to look around the room with that knowing look that one gives to indicate that they're involved in very important matters indeed!
[Sound Effects]: Silence, then the brief chirp of a single cricket.
[Stage Direction]: Deflated, Addle continues with his speech.
[Addle Gehirnberg]: We set the January 2009 trial date in the Schwein case with the understanding that it might have to be postponed. Through no fault of the defense, the Sparkle trial did not conclude until April 13th!

[Stage Direction]: As Addle continues to argue the specifics about dates and times, we cut away for intermission. At the beginning of the next segment, we find Addle still preparing to come to the point about his inability to manage his time in finding expert witnesses.

[Addle Gehirnberg]: It was only two days ago that we were told that there would be a Child Sexual Foundation, Sexual Abuse Foundation Syndrome, expert I'm asking for 3 Weeks. I don't think anyone would be adversely affected with a 3 week postponement.

[Stage Direction]: The Honorable Sidney Lumet directs his gaze to the Prosecutor waiting for her comments.

[Moira McDermott]: We would like the trial to proceed on May 11th ! There are numerous people on this case who have planned their schedules around this date.

[Stage Direction]: The prosecutor briefly outlines the opportunities that the defense attorney should have taken advantage of to meet his prior commitments to the court and to the people of Sempervirens City.

[Moira McDermott]: There is plenty of time for Gehirnberg to attend to those matters. The victims...
[Stage Direction]: Noisily, and abruptly, after hearing the word "victim" Mrs. Schwein interrupts the prosecutor.
[Svea Schwein]: Snort!
[Stage Direction]: Not noticing Mrs. Schwein's snort, the prosecutor continues...
[Moira McDermott]: the victims in this case deserve to have their trial.

[Stage Direction]: Cut to an aside:
[Svea Schwein, whispering under her breath]: I can't find my lipstick! All I have in my purse is "Demur" by Yves San Lawrence, I can't wear that!!! I can't find my usual bright red "HussyBeacon" that I get in bulk 30 packs at PriceCompany! [louder now] Where's my lipstick? Snort, Oink!
[Stage Direction]: A peculiar and unpleasant odor emanates from the back row of the courtroom.

[Stage Direction]: The judge gazes patiently at the defense attorney waiting for his response to the prosecutor.

[Addle Gehirnberg]: I'm still reaching out to experts [eyes roll and giggles are heard from the public seating area], so that I can prepare for trial. No single witness could have possibly known when their testimony was needed.

[The Honorable Sidney Lumet]: To the extent that the attorney is charged with adequately representing his client, Under the circumstances I will agree to a continuance to June 1st, BUT, it WILL be June the First...

[Addle Gehirnberg, rudely interrupting the judge]: I have no doubt about that your honor!

[The Honorable Sidney Lumet]: I WILL be in this courtroom, and It WILL be June the first...

[Addle Gehirnberg, again interrupting the judge]: We will be in this courtroom your honor absolutely, without a question .

[Stage Direction]: At this point Addle uncrosses his fingers and toes, as Billy Schwein shuffles conspicuously back to stand by the door, next to his wife, Mrs. Schwein. Billy Schwein has a pensive look on his face as he thinks about the fact that his wife is looking disheveled and emaciated of late, and that she's going to have to make a better effort if he's going to be able to use her to prop up his image during the trial, if they ever have it... Maybe he should have divorced her long ago, and married his doctor friend Etha Byron, she understands his "needs" even better than Svea does!

[Props and Effects]: The screen fades to black.

Word on the street is that the 10am time is correct, reliable sources indicate confirmation of the 10am time through the DA's office.

UPDATE (Wednesday, April 22, 2009, early morning):
There seems to be some level of disconnect about the TIME of the hearing. On 04/21/2009 in the afternoon, I contacted the criminal court to re-confirm the 10AM time . The clerk said that there are other hearings scheudled for the morning before the ayres hearing, but that continuance hearings are scheduled, not lumped in, and that the ayres hearing is clearly scheduled for 10am.

Having said that, there is also reliable information that the hearing could occur anytime after 8:30AM on the 23rd. I will try to get further clarification at some point today, but I'm guessing at this point that 8:30 is probably the target time, unless someone has better info...

Phil Spector Verdict

The Jury has reached a verdict in the Phil Spector Trial. They will announce the verdict no earlier than 2PM PST.

Let Healing Process Begin

April is National Child Abuse Prevention Month. It seems appropriate to remind the community that it was two long years ago, in April 2007, that William Hamilton Ayres, a formerly licensed child psychiatrist, was arrested and charged with molesting male children sent to him for therapy.

He has been out on bail, living in the community, since that time. His attorney, Doren Weinberg, of the Phil Spector trial, has repeatedly delayed Ayres’ criminal trial.

It is known that it takes great courage for male victims of child sexual abuse to speak out. To date, there have been at least 40 men who have reported abuse by Ayres. It is also known that the effects on victims last a lifetime, and delaying the trial this long means the men cannot even begin to heal.

Warning if you're a victim:

There are a couple of comments made by the interviewers which may be troubling:

1. One of the interviewers, in talking about a molester (who's cover of choice was to be a school teacher) tried really hard to give him credit for being a "fantastic teacher" who "happened" to also be a molester. This kind of thing enrages me. It certainly IS OK to take away "credit" when the goodwill is only earned to be a useful tool to get to victims more easily. NO HE WAS NOT A FANTASTIC TEACHER. WHY DO I NEED TO BE THE ONE TO SPELL THIS OUT?? To be fair, I DO NOT think that the interviewer intended to be insensitive about this, and perhaps for people not in my position, it's not really an issue (and frankly I think that THAT is a big part of the problem); but for me, it becomes the unfortunate focal point of the interview.

2. There is a fairly blunt description of how long this crap will affect the victims. I know it instinctively, but it was fairly traumatic to hear it out loud, and not coming from the voice inside my head...

Ms. Balfour gave a another great interview. It's good to have someone tenacious there, when mostly you just want to hide your head in the sand.

David Gross, who has spoken publicly about william h. ayres on several occasions recently added the following comment to my "Stop Supporting Child Molesters" posting below, and with his OK, I've copied it here, so that it's not overlooked. Thanks for taking the time to read and post David!

Comment Follows:

First off I do not want to be labeled as anonymous. My name is David Gross and I was a victom of Ayers in 1974, and was referred to ayers by my pediatrician who was my father. I am a 50 year old gay male and while homophobia may keep staight men from wanting to talk about homosexual molestation, I have no qualms about discussing or admitting that these things happened.

I know both from having grown up in a medical household and being gay that ayers did what he is being accused of. As for the reasoning by some of his defenders that he was an outstanding shrink and that he did much good, I would like to point out that all of the people being brought forth in major embezzeling crimes for either millions and in 1 case billions of dollars anyone who gets away with crimes for years are all proficient at their jobs and are always well thought of, that is how they are able to get away with their crimes for years.

Boys do not make these claims because of the negative connotations that come with these acts and for years feel that it may be because they have homosexual desires that they are ashamed of. how any intellegent or professional person could think that all of these allegations are fictitious better look at themselves and figure out why they can not accept that this was happening.

I have not and will not try to gain any monetary benifits from this experience. Maybe because I am gay I can see the situation more clearly than most and would happily testify against ayers if asked. Unfortunately this whole situation has probably affected the relationship I have with my father, for while he hasn't supported ayers at all he hasn't publically denounced him and has not actively attacked him in the medical community, being obout the same age as ayers if it was me I would have looked him up and physically kicked his ass up and down the street. I would love the chance to confront him and will try to be at the trial if at all possible with my work schedule.

He is scum and should not be allowed to continue having his freedom and needs to spend whatever time he has left on this earth in prison for the lives that he has ruined. Anybody who had been informed of his actions and ignored the information is in my opinion an accessory to a crime and is lucky that they are not being prosecuted along with him, maybe this would have saved many young boys from having been victoms over the years after the 1st complaint was made. the longer this farse goes on with all the delays just prolongs the pain of the victoms.

If ayers was poor and had even one witness claim they saw him commit a minor crime he would be sitting in jail, yet money and his professional status has kept his freedom when this should make the crimes even more henous. I'll climb off my soapbox for now, but I may climb back on it if I deem it necessay to help get justice served. Thank you all for your time taken to read this.

The article speaks at length about the ayres case, and provides a pretty cohesive summary of the details of the case. Of interest specifically are comments about how ayres’ “controlling and vindictive… [] … hidden traits became public.”

Just go read it for yourself. It’s very well written.

At the moment, because I’ve been thinking about shrinks in general a lot lately, I’m mostly interested in some of the statistical information presented in this article, which unfortunately parallels my general thinking on the subject.

Some specific points pulled directly from the article (Paraphrased):

1. Of the practitioners accused of sexual misconduct, 97% are males ranging in age from 22 to 82, mean age of 53, and mean of 25 years in practice.

My comments:
This data counters the claim that ayres is no longer a risk because he’s “old,” which apparently was one of the arguments used when reducing his bail, along with the idea that he won’t offend any more because he’s not practicing any more, and that’s his modus operandi. (Who defined THAT as his MO?? If you ask me, the MO in this case is acting on homosexual interest in underage boys… getting paid by parents to have easy access and a good cover story, and having county and court officials select victims who won't be believed if they report are just added bonus... not MO. )

Criminy... it’s like saying that since he's no longer practicing, it’s not possible for the pervert to just trade child porn with buddies or go to downtown SF and pick up underage male prostitutes, pretty much with impunity, whenever he gets the urge. No! No chance he's still perpetrating! Good job protecting the population, judges! *golf clap*

2. Higher proportions of sexual misconduct reported for the following specialties: family practice, obstetrics/gynecology, and psychiatry. The AMA reports that in the psychiatric specialty between five and ten percent of psychiatrists have had sexual contact with at least one patient, based on self-reporting studies.

My comments:
Okay! So: If you mistakenly decide that a shrink is the way to fix whatever thing you think a shrink knows how to fix, odds are fairly good that you’ll pick one who is really only planning to take advantage of your state of mind to USE YOU to get off to whatever bizarre sexual peccadilloes got them interested in psychology to begin with. (ref: Ted Bundy)

Maybe they won’t abuse your trust right away. Maybe they’ll wait until you’re really dependent on them for your mental health, and then they’ll really give you a good mind fuck.

Ever been robbed? Something minor...? Like maybe someone took some cash or a trinket while you weren’t looking? Remember how violated you felt? Well this is a whole lot worse; and it has the added benefit of lingering and festering for a good long time.

This is my advice to people who have children, and who think that their children could benefit from psychotherapy: Don't.

If the shrink is one of these 10%, and they do it to your kid, it will be something that they get to live with forever, warping the way they are able to trust other human beings, warping their self-confidence, warping their self worth; very deeply warping the very way that they perceive the world every day. Good luck fixing that.

What’s the answer if your child HAS to go to a shrink? I don’t know.

Probably start by eliminating male shrinks from your shopping list; that reduces the odds of abuse apparently; if you trust those statistics. Being upfront and very clear with the shrink about the corporal results they should anticipate for any perceived transgression is a good STARTING POINT.

I think at the very least insisting on audio/video recordings of all contact, or always being present is probably best. Good luck with that though. Shrinks will guilt you into feeling like you’re going to damage the “processes” by being present. Or they’ll tell you that you'd be violating patient confidentiality, or that maybe you’ll feel like retaliating for anything negative your child says, and you’re not smart enough to manage your feelings about what you hear… But ultimately they probably just like their privacy while they’re getting off.

So to be clear, if this article is correct about the AMA’s statistics, the odds that your shrink is sexually abusing someone are:

Better than the odds that you’ll win the lottery.
Better than the odds that you’ll be diagnosed with cancer this decade.
Better than the odds that you’ll get in a fender bender this year.
Better than the odds that you’ll win the door prize at your company picnic.
Better than the odds that you’ll get your neighbor’s mail in your mailbox today.
Better than the odds that you were planning to have pizza for dinner tonight.

Better think twice before going to see that shrink.

If you choose poorly and decide to go anyway, I hope he doesn't take a cotton to you.

8:42AM Doron whines to prosecutor about how he’s so terribly important and busy with the Spector trial and can’t possibly do the victims the benefit of even putting on a show trial during ayres' lifetime. (Well… not his EXACT words, but you get the idea…) Prosecutor makes a pretty good show of being angry about it. (Thanks Melissa!) I know that I was feeling embarrassed for Doron.

Sometime immediately thereafter, probably between 8:45 and 9AM: Court is called to order and they give the judge the “for real, firm, really going to happen this time… for sure, not to be changed trial date of:

MAY 11, 2009 at 8:30AM

(Remember to use PENCIL when you mark your calendar! BUT... you can use a pen to tally your guess as to the number of underaged male "sex workers" you imagine the Pedophile is possibly victimizing as his trial dates keep getting pushed out.)

No pre-trial hearing is scheduled. (Clarification: there is no further pre-trial hearing planned, as it seemed from discussion immediately before the hearing that there were no plea-bargains offered; or if there were, they were not terms that were acceptable to the defense, and so the judge appeared mostly concerned with making a trial date stick. )

The judge then basically said: no point in discussion today as no one has anything to offer, buh-bye now.

And everyone filed out, with The Slattern doling out dirty looks for all. The Pedophile helped a young woman with her jacket. Safety warnings were not issued, as the Pedophile appears only to like young boys.

The whole thing was over quicker than you can say "Watch out for shrinks, they're a bunch of sadistic, manipulative perverts!"

Quite a let down. Although, I’m a bit delirious, as I’ve only slept about an hour in the last 40 hours.

Maybe I’ll post more later. If I post more now, it will be very filthy, and everyone's eyes will bleed.
