The Wanderer Newspaper has a Big Article up on the Ayres case

This article was just published in the Wanderer, a long-running Catholic weekly. Volume 142, no. 26. June 25, 2009.
This is for paid subscribers only, but we received a copy of the story. Nice to see the plug for our blog in the story as well.
Molestation Trial . . .
Might Begin Soon For Prominent Psychiatrist

By PAUL LIKOUDIS

The long- awaited trial of San Mateo psychiatrist and alleged pe dophile William Ayres, once one the nation’s leading advocates of childhood sex education in the 1960s and a former president of the American Academy of Child and Adolescent Psychiatry, has been set for June 23.
Ayres, 77, was arrested in April 2007 on charges he molested pre teen boys sent to him for psychi atric evaluations, but allegations against him for sex abuse were first made more than 20 years ago, though rarely pursued by the police. At the time of his arrest,
The San Francisco Chronicle’s John Cote reported on April 6, 2007 that Ayres “was a fixture in San Ma teo County mental health and po litical circles. He served with San Mateo County District Attorney Jim Fox and Supervisor Richard Gor don on the county’s Children and Families First Commission, and in 2002, he was honored by the coun ty board of supervisors with a life time achievement award for ‘his tire less effort to improve the lives of children and adolescents.’ “ During his long and distin guished career as a local child psy chiatrist, he received patient refer rals from the San Mateo County juvenile justice system.
“ From 1993 to 1995, he served as president of the American Acad emy of Child and Adolescent Psy chiatry, the leading professional medical association for child psy chiatrists with more than 7,500 members nationwide.”
At the time of his arrest, he was charged with 14 counts of lewd and lascivious acts with three mi nor boys, but in the years since, largely due to the work of New York journalist Victoria Balfour, who began searching and track ing down other possible abuse victims, that number has now grown to, at least, 22 victims.
Ayres’ arrest, continued Cote, “ follows years of accusations against the doctor that raised red flags but never amounted to a criminal case. It was only after San Mateo police received a com plaint in 2002 that authorities ob tained a search warrant in March 2006 for Ayers’ medical records, police said.
“Among some of the other accu sations that are documented in pub lic records but never led to crimi nal charges are the following: “At least five men — none of them the alleged victims in the crim inal case — claim in police reports, civil depositions and a Child Pro tective Services report that Ayres molested them in their youth.
“ One of those former patients sued Ayres in December 2003, ac cusing the psychiatrist of mastur bating him under the guise of a medical exam on multiple occasions in the late 1970s when the patient was 13 years old. The case was set tled confidentially in 2005.
“Police investigated at least two other molestation reports against Ayres before the 2003 lawsuit, records and deposition transcripts show. One was determined to be ‘ unfounded’ in 1987, and the al leged victim in the other didn’t cooperate with police, according to those records and statements.
“At least two other men came forward separately in 2005 saying Ayres had also molested them as teens in the 1960s and 1970s, but the cases could not be prosecuted because the statute of limitations had expired, police reports show.”

The San Mateo County Times’

Elizabeth Pfeffer reported on May 30, 2009 that the prosecutor in the case, San Mateo County Deputy District Attorney Melissa McKow an, said that accusations against Ayers go back at least 30 years.
One of the many reasons Ayres trial has been delayed so long is
that his attorney, Doron Weinberg, has been preoccupied with an other high- profile client, the mu sic producer Phil Spector, who was recently jailed for life for the mur der of actress Lana Clarkson.
Police first began investigating Ayres in 2002, reported Pfeffer, “ after being told by a man who was a patient of Ayres in the 1970s that the doctor had molested him on multiple occasions. But the case had to be dropped after a U. S. Supreme Court ruling effec tively changed the statute of lim itations on such cases.
“ Childhood molestation can only be brought by victims who are younger than 29 or whose al leged abuse occurred after January 1, 1998.
“ The San Mateo Police Depart ment reopened the case in March 2006, at the urging of a friend of one of the victims to seek out oth er possible victims who fell with in the legal statute of limitation.
“ That friend was New York based freelance writer Victoria Balfour, who made it a personal crusade to unearth possible moles tation victims of Ayres and help authorities build a case against him.
“A search warrant was executed for Ayres’ records, and a list was compiled of more than 800 pa tients. Prosecutors believe they know of at least 39 former patients of Ayres who had been molested by him, but most did not fall un der the state’s statute of limita tions.”
Pfeffer also described some of the reasons for the delay in the tri al: “The first major setback came in February 2008 when Ayres was di agnosed with prostate cancer and a judge postponed the start of his trial from March 10 to June 23 of that year, in order for him to seek immediate treatment.
“A month later, a state appeals court ruled that Ayres deserved a new hearing on a defense motion that could have destroyed the pros ecution’s case against him.
“ Weinberg planned to try to suppress evidence gathered from Ayres’ patient files on the basis that the warrant violated the state’s psychotherapist- patient privilege, lacked probable cause and permitted constitutionally prohibited searches.
“ The motion was ultimately dismissed but a further delay came when San Mateo County Su perior Court Judge John Runde unexpectedly recused himself from the case. Both prosecuting and defense attorneys were baffled by the event, and a new trial was set for January 2009. That date, however, conflicted with the scheduling of the Spector murder trial in Los Angeles County Supe rior Court.
“Ayres was known nationally,” Pfeffer continued, “ as one of the country’s top child psychiatrists; he was just as well respected on the Peninsula where he ran a pri vate practice for decades. He was probably one of fewer than ten San Mateo County psychiatrists with a subspecialty in child and ado lescent psychiatry, according to San Mateo County Medical Asso ciation Executive Director Sue Malone.
“ He told colleagues he per formed medical examinations be cause that was the way he had been trained. He had done his res idency in the early 1960s at the Judge Baker Center in Boston, one of the country’s premier cen ters for the study of child psychol ogy.”

The San Francisco Examiner’s

Kate Williamson described, the day after Ayres’ 2007 arrest, the prominent role he played in this country’s national sex education debate in the 1960s: “ In 1968, lo cal school districts became ideo logical battlefields in a debate about whether sex education was a proper subject for school. In few places were the arguments as loud as in San Mateo County, where parents boycotted school bond is sues and filed a lawsuit to keep ‘ family life’ education out of the classroom. And at the center of the debate was child psychiatrist Wil liam Ayres, a nationally quoted expert portrayed in many articles as a beacon of reason, accuracy and science.
“Ayres achieved national fame in 1968, after he co- scripted and helped narrate ‘ The Time of Your Life,’ a 13- part television series produced by KQED for use with fourth through sixth- grade stu dents that teaches the broad top ic of family life, including can did sexual discussion. It was praised by educators and doctors, according to
San Francisco Ex aminer
and
San Francisco Chronicle newspaper articles of the time, but a number of parents objected loudly, declaring it ‘ por nographic.’ Ayres himself said the series was helpful to children.
“ ‘ For many years, kids have been coming into my office know ing some of the “ facts of life,” but with many facts left out. They wind up being bewildered, with a great many concerns and anxieties resulting from their lack of knowl edge,’ he told
The New York Times
in 1969.
“ School officials at the time praised Ayres’ approach.
“ ‘ Our only disagreement is on the depth he went into on mastur bation and the details of human intimacy,’ Assistant County Super intendent of Schools Armin Weems said in August 1968.
“ But in the face of opposition, the San Mateo County Board of Education stopped requiring use of the videos in September 1968 after a trial run with its pilot fami ly life education training, news ar ticles indicated. San Francisco schools dropped using the videos in their own family life program after showing them in the fall of 1967. Both areas still kept sexual education as part of the curricu lum, spurring a parents’ group to file a lawsuit against the San Ma teo County board. The group lost, and the United States Supreme Court dismissed its appealed suit in 1976, according to news re ports.”

His Collection

During a pretrial hearing on June 15, reported
The San Mateo County Times’ Elizabeth Pfeffer, Ayres attorney Doron Weinberg tried to persuade Judge Beth Free man to rule the inadmissibility as evidence against his client some of the books containing nude photographs on young boys po lice found in Ayres’ files.
“ Doron Weinberg told Judge Beth Freeman during a pretrial hearing in San Mateo County Su perior Court that police were not legally authorized to take three graphic picture books from Ayres’ file cabinets May 31 during a search for the missing files of two former patients who will testify against him during the trial. . . .
“ In other motions heard Mon day, Freeman allowed four accus ers who are technically out of stat ute to testify against their former psychiatrist. The records for two of them were missing, and in a recent attempt to uncover them the San Mateo Police Department found the books, which were inside Ayres’ file cabinets.
“ The books were located inside some of seven cabinets that had been stored in a San Mateo Police Department property warehouse since 2006, when a judge ordered police to seize all of Ayres’ patient records.”
From California, several inter ested are “ live blogging” the jury selection process and, presumably, will be live blogging the trial. Some of the most extensive infor mation on Ayres can be found at http://www.williamayreswatch.blogspot.com/, which reported recently that Vic toria Balfour has been barred from observing the trial. “ Weinberg also continues his confrontation al ways by arranging to have freelance author Victoria Bal four, the civilian whistleblower who was a driving force in get ting this case brought to trial, re moved from the courtroom, stat ing she is a potential witness,” reported the blog.
“(Even though Balfour’s knowl edge of the case would be consid ered hearsay, as she didn’t observe the abuse and has never had any contact with the seven victims within statute. Because Balfour is a published author, with works ap pearing in
The New York Times, The Washington Post, People, and
Vogue,
among others, one might argue there are some First Amend ments rights being stepped on here by the defense attorney. . . .) “ The [ Ayres] case took on new life in 2005 thanks to Balfour’s own detective work, locating and encouraging former patients of Ayres to speak up about their own abuse, knowing her friend’s abuse ( and the complaint brought in 1987) could not pos sibly have been the only two cas es of molestation. Police in San Mateo began to investigate in earnest, executing a search war rant for Ayres’ patients’ records, identifying possible victims of abuse.
“Ayres had been treating coun ty- referred patients as recently as 2004. . . .
“ This trial will be the first time most of the alleged victims will be testifying in open court. Dur ing a preliminary hearing in 2007, police officers testified in lieu of the former patients, re vealing information the men have shared during the investi gation, describing their ages and their experiences during their ap pointments with Ayres. One San Mateo officer testified that one of the young men said Ayres told him no one would believe his stories of abuse — that no one would believe the good doctor had done such a thing, and no one would believe a troubled teenager.”

Where in the world is Victoria Balfour?

After so many years of pushing for ayres to be prosecuted for child molestation, where is Victoria Balfour, and why have we not seen her articles on the trial in the paper? Balfour, who is on assignment for a California newspaper, has been barred from the courtroom.

Who exactly is responsible for this barring is a bit muddy:
Ostensibly, Doron Weinberg, attorney for the defense, has made overtures that he will call Balfour as a witness. From behaviors observed in the courtroom however, it appears that the prosecutor, Melissa McKowan is possibly more opposed than Weinberg to Balfour’s presence during the trial.

Unfortunately, to the best of anyone’s knowledge, Balfour has not been summonsed, and the witness list is now sealed, so it would be impossible for any member of the voting San Mateo County public to verify that Balfour is indeed to be a witness. Barring any proof that Balfour will be a witness, it’s troubling that a member of the press would be barred from an otherwise public trial.

We would have hoped that James Fox, DA, or his deputy, Steve Wagstaff would have stepped in by now to rectify, or at the very least clarify to the voting San Mateo County public Balfour’s current status as a member of the press, and public.

There are victims and parents out there who are, for various reasons (Work, pain involved in being in the courtroom near this monster, etc…) can not be in the courtroom every day during this very important and painful trial, and yet have the desperate need for daily progress updates. Given the fact that the press in general is reporting only on the most scandalous of the trial highlights, WE need someone in that courtroom to provide attentive, professional, detailed daily updates. Balfour can do this for us, as well as complete her assignment for the newspaper she is representing.

But only if she’s in the courtroom.

Week 3 of Trial - Motions and Motions (and more jury selection?)

Jury has been seated: 12 Jurors, 4 Alternates.
(Some accounts are now saying 6 alternates, and that one of these is already in place, as one of the 12 jurors has consulted with a "spiritual advisor" and can no longer judge another person.)

The jury will NOT be allowed to see Ayres' pedophile photo collection.

Witness list is sealed.

Opening Statements on Tuesday, June 23, 2009.

For those who can't make it to the courtroom on a daily basis, the fastest way to get information is through the Superior Court Clerk's office:

Updates are below this post:

BREAKING NEWS - NO BOOKS

From Michael Stogner, posted at the the smdailyjournal forums:

Books not allowed

The Defense motion to suppress the three books that were found by the San Mateo Police Department in the file cabinets of Dr. William Ayres this last month, has been granted. The books are not in the trial.

12:20pm Update: Story in the San Mateo County Times is NO LONGER available:
5/31/2010 Update: here's a another link about the books being disallowed: San Mateo Daily Journal.

Defense attorney Doron Weinberg praised the judge's decision.
"We don't think that they would have made a significant difference in the case," Weinberg said. "The evidence wasn't relevant or critical, but we believe the court ruled correctly."

Thank God Judge Freeman has someone intelligent there to tell her how to do her job!

Friday, June 19th Update: New story in the San Mateo Daily Journal, States that 6 alternates were selected, and one juror already replaced.

Ruling on Pedophile Photo Collection TODAY - Jury Seated!

The ruling on whether or not the jury will get to see ayres' collection of sexually charged photos of boys aged 5ish to 16ish years old, in various stages of undress from the process of stripping for the camera through full frontal nudity, should be made in court today.

The jury selection was apparently finished yesterday, 12 jurors sworn, with 4 alternates.

Trial is expected to proceed with opening statements on Tuesday.

There is an article about all of this in the San Mateo Daily Journal. It's not very well written though. It does contain the long awaited info about where we really are in the jury selection process, but it calls the photos "textbooks depicting nude boys." Far from accurate, far from objective. Let's face it everyone: There is no reasonable argument that these are "textbooks."

Warning: An Investigator for Ayres may be calling people to pump them for information

One of our readers just got a call from a man claiming to be the father of two victims who won't go to the police. This "father" refused to give our reader his name or contact information. He claims not to know his way around the computer, but somehow found our reader via the internet and by reading this person's blogs on the internet. This reader is someone who posts under his real name, so this so-called "father" of a victim would have had an easier time tracking him down.

The man was fishing for any information from our reader on the case and asked questions about potential witnesses... He always says he travels a lot and is hard to reach. Won't give you his work phone number because he says he can't talk about the Ayres case at work (but strangely he tells people he is making these calls from his office.)

We would have given this person the benefit of the doubt had not other people received the same call from this same man in the last two years. Won't give out contact info, lies about how he gets your contact info and although he promises to call back or email, he does not.

We strongly suspect that this man is an investigator working for Ayres' lawyer. If this man makes a cold call to you out of the blue and says he is the father of a victim or is a friend of the victim but the victim won't come forward and says he is looking for information on the case and yet he refuses to give out contact information, do not talk to him. If he gets cagey when you ask for contact information ( on caller ID the number always shows up as a private number) do not talk to him. Get off the phone quick.

This sort of thing is more likely to happen if you are posting under your real name. Those who are posting anonymously here and under other handles elsewhere should be safe from this creep.

Week 3, Day 1 - Additional Afternoon Information.

NOTE: Please see the post BELOW this one as well, as that post has also been updated through the day.

Below is the summarized information from this afternoon’s trial as told to me. There will probably be errors, or misstatements, but the gist should be pretty on target. If you were there, and have corrections to this information, you can email deepsounding, and he will fix it. (Contact info on the right side navigation bar.) This information may conflict with other information posted by others here today, if so, just remember that this is summarized info as told to me by someone else.

It appears that ayre’s son may indeed be sitting in the courtroom with Solveig and ayres. Identity is not confirmed, but the man is about the right age and entered with ayres and Solveig and sat next to Solveig. Also, the woman with Doron Weinberg was apparently another attorney.

There is a jury pool of 187 who have not been excused for vacations, medical, and other similar reasons. On Tuesday, June 16th 2009 112 of those jurors will be in court for the voir dire process to begin. Judge Freeman stated that voir dire will be finished by this Thursday. Current speculation is that the trial starts in earnest on Tuesday, June 23rd.

The Three Books:
(I’ll try to get this in order, but can’t be entirely sure of chronology.)

During the warrant to search for files to contact in-statute patients, files were found in file cabinets. These cabinets (and possibly other things?) were taken into POLICE CUSTODY, and per the warrant, the PATIENT FILES were sealed and only the special master was allowed to look, to report contact information ONLY to the police officers, who were then to contact those potential victims. IF we’re understanding this correctly, at the time, the special master SAW, but did not access two books in one of the file drawers, and one manila folder which did not appear to look like a patient file. The special master apparently reported ONLY the names and contact information, as per the warrant. The rest of the material (cabinets with books inside) REMAINED in police custody, but were not accessed to preserve integrity in the special master process.

At some point later (something like a year… not sure. This part is a bit fuzzy..) Doron Weinberg complained that two or three potential victims on the “list” did not have their files turned over to the defense, and he asked for the files. (Weinberg says that he stated that they were not included, but he did not ASK for the files.) At this point an officer went to retrieve those two or three files from the file cabinets STILL IN POLICE CUSTODY, and with the written consent of those two or three patients. The officer saw the books laying in the cabinet, but did NOT state this in his report. (Again, story is even more fuzzy right here.) Even later (recently) an officer went into the cabinet (not clear why…) and HE then saw the books and looked in the manila envelope to find additional printed material. He then talked to the second officer, who (I guess) indicated that he saw the books when he looked, and someone had him write a report stating that he had seen the books. (again… fuzzy… could have this a bit wrong, but this is the general gist.)

Of course Weinberg is arguing that the whole thing is inadmissible because the warrant didn’t allow them to “go back” a year later. McCowan argued that there’s plenty of case precedent for this kind of thing, for example, they take a backpack into custody under a warrant, and then later open a pocket to find evidence, as long as the property was taken into and remains within police custody the whole time, there is no violation of the intent of the warrant. On and on they argued. The judge boiled it down to one simple problem: Did the officer(s) have the right to get stuff from the file cabinet. The judged requested additional case examples from McCowan, but seemed to indicate that she feels that McCowan’s example of the backpack applies to this situation. She also indicated that she feels that the officers acted in good faith.

Judge Freeman was also not happy with some procedural errors that McCowan has made; duplicate evidence numbers, asking leading questions of the officers, are two examples. We won’t dwell on this, we want the prosecutor to be focused and sharp.

So what’s in the books?
It is not entirely clear, the books were not shown in great detail; of the two hardcover books, one had a blank red cover, and the other a white cover, apparently the one with the white cover has a picture on the front of young naked children. The manila envelope was described as containing pictures of boys "aged 12-16" in a locker room situation. To paraphrase and summarize the statements that the officers present used to describe the contents of the books: the books had pictures of naked young boys in pornographic “sexual poses.”

EDIT: (DS): There is now an article in the mainstream press with more specific detail, officer names, book titles, etc..:

Ok. I need to go wash the vomit out of my mouth now.

Week 3, Day 1 - Weinberg Attempts to Split Hairs on "Groping"

On this first day back in the courtroom since Wednesday, June 10, Weinberg got out of the starting gate by requesting that the testimony of a victim who said that Ayres had groped him be thrown out on the grounds that it did not constitute groping. Tragically, the young victim himself was in attendance in the event that the judge would call to have him testify. After a chambers conference, the prosecutor, appearing upset and frazzled, took the victim out into the hall. In the end, the victim did not have to testify and was sent home. The evidence presented came from the prosecutor's notes. She said that the victim alleges that the good doctor stood behind him and used the "back of his hand" to grope him. Weinberg- ever the hair splitter - argued that using the back of a hand does not constitute groping. Weinberg actually had the nerve to say that this bizarre and illegal touching - the kind of touching that has actually sent other child psychiatrists and pediatricians to state prison for scores of years -- was nothing more than just a physical "exam."Judge Freeman disagreed, saying that the appellate court has ruled that this shows" intent." Weinberg's motion is denied. The testimony stays in.
Officer Rick Decker from the San Mateo PD was sitting with the prosecutor, who was wearing a tan suit and flowery low-cut blouse this morning.
There was also a tall, dark haired bearded man sitting with Solveig this morning, perhaps in his forties, with hunched shoulders, watching the proceedings intently. We suspect it may be Ayres' son Robert, in from Chicago. If this is confirmed, this would be the first appearance of either of Ayres' children to attend a hearing or the trial.
There was a woman with black hair sitting between ayres and Whineberg this morning. Is it because Whiney himself is starting to get the heebie jeebies from sitting next to the creature ? On the other hand, the woman is probably a lawyer who works for him. Possibly either Marilyn Waller or Nina Wilder.
The creature himself, in a grey suit, white shirt and dark tie, looked very grim and downcast. That's fine by us.
Solveig wore a cream jacket, brown slacks and orange shirt. Although that ubiquitous smile was plastered on her face, to many it appeared that she is actually close to tears.
In other matters, juror #92, a 77-year-old man, was excused from the trial because he has to take care of his 100 year old mother who is dying in Santa Rosa. We can't say for certain, but it appears that this man had already been picked to be a juror. We think it's going to be a lot more difficult to seat a jury for this case than the prosecution knows. What person in their right mind would want to sit through testimony about a pedophile during the fine summer months? Whoever is ultimately picked for the jury, we salute them for performing their civic duty.
The prosecutor and Weinberg are meeting in chambers with the judge for the rest of the morning. Motions in the courtroom continue this afternoon at 1:30 pm.
They're now talking about having opening arguments start on Tuesday, June 23, 2009.
Weren't there some commenters here who predicted that date? Some think arguments might not even start then.
Afternoon Session Update:
We were unable to attend the afternoon session, but we hear from someone who did that Weinberg is fighting to keep out three picture books found in Ayres' storage locker as evidence. The word "pornography" came up several times.
If anyone was in attendance we would like a report.
Afternoon Update Part Two

This just in from a courtroom spectator. There are three books that the prosecution wants in as evidence. They are illustrated books. One was noted as evidence back in 2006 but for some reason the police just added two new books they've had in their position since 2006 but just added as evidence this past May. The books are oversized and thick and were found in Ayres' storage locker. Two were found in a drawer and the other was found in a large envelope with the end torn off. Sgt. Mac Laner found the book in the envelope. The big red book is called "The Sex Book" ( not the one by Madonna, we presume.) A police officer, Chris Noa, testified that on the cover of the big white book they found , there was a picture of naked boys on the cover, but then he amended that to "naked children on the cover." He testified that he told Detective Rick Decker about this, but Decker testified he didn't remember anything about this. There was also testimony that Special Master William Nagel, the judge who oversaw the patient files seized from Ayres' storage locker, also saw the books when he was going through the files. The question is- why were two of these books not submitted into evidence until now? Weinberg, apparently had complained that three files of boys were missing, and when the police went looking for them in May, they found these two new books.
All we can say is, these books must not be good news for the doctor or otherwise Weinberg would not be fighting to keep them out of the trial.
Better late than never, San Mateo PD!

Week 2, Day 2 - Jury Selection - Detail

Updates from June 9th, 2009:

1:00PM:
From "Sarah", posted at the SM Daily Journal:
Went to jury selection and the bailiff told me that there is gonna be 150 today and that I wont be able to sit down at all. And yesterday there were 250 jurors, so im going to go back at 3:30 and see how many there are remaining.
-Thanks for the update Sarah... please keep us all posted!

Also, as an anonymous poster noted: There are actually NO jurors SEATED yet: there are some (anyone have a count?) who have made it past initial questions, but all are still subject to being dismissed until all challenges have been exhausted.

2:00PM:
One of our correspondents sent in a post lunchtime report. As of 2:00 pm, jurors were busy filling out questionnaires in one courtroom. The other courtroom, held for jurors questioning this morning, was empty. The court clerk told our correspondent that jury questioning was done for the day.

Week 2, Day 1 - Jury Selection - Detail

Monday June 8, 2009: Our correspondents inside the courthouse say that potential jurors for the Ayres case are filling up two whole courtrooms. This morning roughly 100 jurors were questioned and according to our correspondents "two or three jurors" were chosen for the jury.

"They're blowing through the jurors really fast," said one trial watcher.

5:59 PM Update:
One of our correspondents says that every time she went into the courtroom, the prosecutor and Weinberg were having discusssions in chambers. The correspondent will let us know tomorrow the genders and ages of jurors who have made the first cut.

9:15PM Update:
Prospective jurors are being told to expect the trial to end at the end of July or early August. Sounds like they blasted through at least 200 prospective jurors by the end of today; many being excused due to already scheduled and paid vacations, already planned weddings, etc..., as would be expected during summer months. We may be able to get an update on the count so far tomorrow.

We will provide further details when we can.
