Short post, But THREE topics of interest:

One:

Two:
A blogger on DailyKos.com by the name of SwedishJewfish has posted a tribute to victims of childhood abuse to counter the celebrations today honoring the life of Joe Paterno, who enabled child molester Jerry Sandusky to continue to abuse over the past decade. If you've read my posts in the past weeks, you know that this is an issue that has bothered me too.

Her idea for a tribute is FANTASTIC. You should go read it, and "recommend" it, if you're a member of the site. You should also donate to RAINN.org on her page, if you feel so inclined. (RAINN is the "Rape, Abuse & Incest National Network") and her donation page is right on RAINN's website. The money you donate goes directly to RAINN and is TAX DEDUCTIBLE. They will give you their federal tax ID on your donation receipt.

By the way, make sure you read the last paragraph at the end of her post. It really does a great job of summing up every pain that needs to be understood, and that normally goes unsaid.

Three:
Pennsylvania Governor Corbett has issued an official expression of condolences for the death of Joe Paterno, stating that "Joe Paterno confronted adversities, both past and present, with grace and forbearance." Further, the Governor has ordered the State Flag to be lowered to half staff in his honor.

In response I have written the below letter to Governor Corbett. Please feel free to lift, plagiarize, cut, paste, bend, fold, and spindle the below, and use to send him a letter or email of your own.

Dear Governor Corbett,

I took a moment today to read your January 22, 2012 expression of condolences on the death of Joe Paterno, and your January 23, 2012 State Flag half staff order in honor of Joe Paterno.

I understand that Joe Paterno has meant a great deal to the State, in terms of fame and publicity, as well as in his “Generosity to Penn State as an institution.”

I would like to take a moment of your time to call attention to the grave damage that child molestation does to its victims. In most cases, children in such situations develop an intense mistrust of the very people who should be able to help them, especially when they perceive that people who should be helping them are failing to do so. These innate, learned responses persist well into adulthood, leading to a very difficult life for many victims of such crimes. In addition to feeling socially awkward our outcast, we typically suffer more health problems than the general population; we have greater odds of engaging in dangerous behaviors, acting out violently, and drug and alcohol abuse. We are often depressed, we have frequent suicidal thoughts, and sometimes, we follow through on those thoughts.

Child Molesters seem to have a unique ability to attach themselves to people who are financially, legally, and politically well connected, so that they have important people to defend them when they are exposed of their heinous crimes. This attachment often becomes insidious, pervasive, and inseparable without perceived sacrifice on the part of the persons defending the molester.

Mike McQueary, Tim Curley, Gary Schultz, Graham Spanier, and Joe Paterno are all people who fell into Jerry Sandusky’s trap, and they DID NOT “confront adversities” with “grace and forbearance.” Instead, they allowed colossal human damage to continue for a decade. Those men were too afraid of damage to their own reputations to stop Sandusky, and it is likely that no one will ever know the number of children victimized.

The victims of such crimes are often very attuned to those people who child molesters use as character witnesses, and the very mention of these supporters opens up wounds anew, almost as painful as the actual abuse was.

Your celebration of the “man,” Joe Paterno, is undoubtedly causing additional pain and grief in those who have suffered, and those who care about them.

It is shameful that your office has issued these tributes without also acknowledging the atrocious damage that Paterno has allowed.

Your office has fallen victim to the same seduction that McQueary, Curley, Schultz, Spanier, and Paterno have fallen for: You gain more popularity by celebrating the hero, than you would in standing up strongly for those damaged. And in so doing, you re-enforce the victim’s distrust of everyone who should have the power to stop the damage.

I hope you will take some time to learn about the damage that child molestation does to people, short and long term, and take it to heart in the future.

UPDATE 01/24/2012: The author of the "F**K Joe Paterno" Post on the Daily Kos site (which I linked to above) has decided to counter Penn State's memorial service for Joe Paterno with a tribute post for victims of child abuse. If you haven't read her original post, please do so now, it's really a VERY good article. She has this to say about creating a tribute page:

I had an idea occur to me this morning though. This was the part of my diary that I felt most impassioned about:

I'm one of the lucky ones. I am unlike the millions of kids who never escape from the cycle of psychological torture and self inflicted violence- the kids and adult survivors who kill themselves, either directly or indirectly. The ones who never make it out ok.

New Ayres Victim Comes Forward: Molested in 1966!

Last week a 58-year-old man bravely contacted this blog to let us know that he too, had been molested by Ayres - in 1966 ! This makes him the earliest known victim of Ayres.

That means that Ayres molested boys in San Mateo for almost 40 years.

This new victim told us that he was 12 years old and at Hillcrest Juvenile Hall when Ayres abused him. The assault took place before Ayres did his sex ed series on KQED called "A Time of Your Life" ( a program that one of Ayres' former partners described to us as "disgusting" and said that it appeared to him that that Ayres had used the creepy program to "procure" boys.)

In 1994, this victim wrote a letter to the California Medical Board stating that Ayres had molested him. They did nothing..... And then, when the San Mateo police were working to get their search warrant on Ayres in 2005-2006 and found out about this victim's complaint to the medical board, for some reason, they say they were unable to find the man, even though they knew the state where he lived, and he has a very uncommon name!

This victim did not know that Ayres had been arrested until last week, when he Googled his name.
He thinks that his search on Ayres was likely prompted by the Sandusky/Penn State abuse case.
What is incomprehensible to him, he says, is that Ayres had gotten away with his pedophilia for so long.

We told him that in San Mateo the culture of protectionism and conspiracy of silence in San Mateo concerning Ayres was even worse than it was in the Sandusky case. San Mateo Children's Services, the medical community, juvenile judges like Marta Diaz who according to San Mateo District Attorney Steve Wagstaffe warned the police who were investigating Ayres in 2002 Ayres to be "real careful with Ayres- because he and I are friends" and then continued to send boys to Ayres for the next two years - were all complicit. According to one reporter who worked for the San Francisco Chronicle in 2005, Wagstaffe went so far as to tell him that Judge Diaz had actively interfered with the Ayres investigation, and that back in 2002, there had been a "power struggle between Diaz and the DA's office", with Diaz telling the police, "Don't investigate Ayres."

It was just last month that a 90-year-old psychiatrist named Dr. McClain Johnston in Menlo Park told us that he had been "hearing stories about Ayres and boys for the last fifty years - since the mid-1960s." Asked why he and other doctors hadn't reported Ayres, he stated, "No one wanted to get involved."

There have been media reports that because of the Sandusky scandal, there's been a fairly dramatic increase in the number of victims of sexual abuse reporting it to the authorities. We believe that this victim is not the only one whose memories of Ayres were jarred by the Sandusky case.

We urge the others out there to contact us at this blog. This includes victims in Boston from 1959-1963, and victims in Wisconsin, where Ayres attended the University of Wisconsin Medical School.

This past March, I was contacted by a 71- year -old man who had been molested in 1949 by a child psychiatrist at Judge Baker, where Ayres worked. This child psychiatrist and Ayres were there at the same time.

We know there are victims who were assaulted by Ayres long before 1966, and we want to hear from every one of you.

Interesting Point

Michael Stogner, San Mateo County resident, and frequent advocate against local government corruption has posted a letter to the San Mateo Daily Journal, pointing out that the organization Friends for Youth, Inc., a local San Mateo County Organization, while vocal about the recent Sandusky molestation case, was apparently strangely silent about the william hamiltion ayres molestation case that has dragged reluctantly through the courts only to end in a fizzle.

In a quick search of the internets for coinciding phrases "Friends for Youth" and "Ayres," I was only able to find two documents with references to both ayres and Friends for Youth, Inc.: The first document was an acrobat document published by the organization in 2009 with a brief mention of the ayres case:

While it appears that there are no cases involving a volunteer from a formal program abusing a child, San Mateo County has seen numerous incidents in recent years where trusted members of the community have committed sex offenses against youth in their professional capacity. The highprofile case of William Ayres, a child psychiatrist from San Mateo who allegedly molested numerous patients over many years, has been headline news.

It should be noted that while the article claims that "it appears that no cases involving a volunteer from a formal program abusing a child," ayres himself received a nomination in 2002 (before this report was written) from now Assemblyman Rich Gordon for a "Lifetime Achievement Award" for his "service on the Children and Families First Commission, and his tireless efforts to improve the lives of children and adolescents." -- Read the post just below this one for my recent comment on this. Further, ayres is known to have been on the board of a local YMCA. And during his criminal trial, he mentioned wanting to renew his "medical license"so that he could volunteer for a local medical clinic that helps families in need.

The second document of interest is a Menlo Park council report from 7/16/2007, which mentions that $2,000 was paid to Friends for Youth, Inc. It also mentions that $1,091 was paid to a Barbara Ayres for "Dental" I believe this to be a co-incidence, as there is a Barbara Ayres (sometimes listed as Ayers) who is a police officer working for the City of Menlo Park. I am reasonably certain that this is NOT the child molester william ayres' daughter.

Apathy and Cowardice

People involved in the exacerbation of the Penn State Jerry Sandusky child molestation nightmare seem to be realizing the extent to which they allowed evil to influence them.

The charity that Sandusky founded (The Second Mile) and which he used to identify and select victims has realized that any good that it may have done can not survive the evil caused by Sandusky:

According to Fox News, David Woodle, the chief executive of The Second Mile has said that "We're working hard to figure out how the programs can survive this event, We aren't protective of the organization that it survives at all costs."

Various collegiate and local political groups have realized that they probably even need to divorce themselves of Joe Paterno, the head coach, who was one of several individuals who supported Sandusky’s child molestation by deliberately and utterly failing to report Sandusky’s evil deeds over a period of many years:

Pennsylvania's two senators, Democrat Bob Casey, and Republican Patrick Toomey have put down their pitchforks and torches for long enough to come to agreement on something: they've both rescinded their support for their prior nomination of Joe Paterno for the nation's highest civilian honor: the Presidential Medal of Freedom. According to the New York Times, the senators issued the following statement in conjunction with rescinding their nomination of Paterno:

"Penn State is an important institution in our commonwealth, we should turn our attention to the victims of these atrocious crimes and ensure they get the help they need. Our hearts and prayers go out to them and their families."

According to the Washington Post, Pittsburgh mayor Luke Ravenstahl has written a letter strongly rebuking Franco Harris, a former Penn State star who spoke out against the firing of Joe Paterno. Harris is a member of the “Pittsburgh Promise” scholarship board. Ravenstahl and the board gave serious consideration to removing Harris based on his support for Paterno before ultimately deciding on the letter of rebuke.

Brown University is carefully watching the situation as well. Joe Paterno graduated from there in 1950, and the university awards a “Joe Paterno ’50 Award” to "outstanding first-year varsity male athletes." They are considering renaming the award, given Paterno's cowardly inaction. According to the article in the Boston Globe, Matt Kutler, a 2001 honoree, said it “wouldn’t be a bad idea’’ to remove Paterno’s name.

So what about the william ayres case?

In January of 2002, ayres was nominated by then San Mateo County Supervisor Rich Gordon (Gordon is now a California State Assemblyman) for a "Lifetime Achievement Award" for his "service on the Children and Families First Commission, and his tireless efforts to improve the lives of children and adolescents."

The resolution was passed by the San Mateo County Board of Supervisors in spite of the fact that several reports of molestation had already been filed (and dismissed without investigation) with various county agencies. Board Members who approved the nomination unanimously: Mark Church, Richard S. Gordon, Jerry Hill, Rose Jacobs Gibson, Michael D. Nevin; County Manager: John Maltbie; County Counsel: Tom Casey

On several occasions San Mateo County Board of Supervisors members have been asked by victims and their families to move to revoke the “Lifetime Achievement Award” and nothing has happened.

Rich Gordon has been asked to do the same on several occasions by me and others -- four times by me, --through his office email, and in facebook posts, and even in person in some cases – emails have gone unanswered, and the facebook posts promptly deleted. In person requests were apparently greeted coldly, consideration promised, and promptly ignored.

I’d like to be able to say that our local politicians are not savvy enough to recognize their cowardice in the face of so much evil – that they are so afraid to call attention to their own shortcomings in supporting ayres, that they don’t want to raise the issue, but frankly the local press and the local authorities, and even the local citizens seem so apathetic to the damage done by child sexual abuse, that the local politicians can just continue to act in a cowardly manner with little fear of the kind of public backlash being experienced by those involved in the Sandusky case.

Same Old Story

Penn State’s resident evil Jerry Sandusky did an interview with Bob Costas last night (these guys always want to talk about themselves and their interest in young boys:

There must have been a molester’s conference that both Sandusky and ayres attended:

COSTAS: What did happen in the shower the night that Mike McQueary happened upon you and the young boy?

SANDUSKY: Okay, we-- we were showing and-- and horsing around. And he actually turned all the showers on and was-- actually sliding-- across the-- the floor. And we were-- as I recall possibly like snapping a towel, horseplay.

For comparison, here’s from the transcript of the william ayres criminal trial for molestation of many young boys on July 8, 2009 :

Ayres’ Attorney DORON WEINBERG: … Did you ever use the results of a physical examination or observation to simply reassure the patient himself?

AYRES: Oh, Yes. Yes. There was – There’s a case in this issue of organic macula, which is a swelling of one – of one of the nipples. And in that situation you certainly would – first of all, is, you need to check to make sure that they’re – so that you know that it is a physiological condition, which is normal. Because it is quite normal, and you can have it bilaterally or on one side.
On the other hand, they need to know – many, many boys are very, very anxious about it, and they need to start looking around. And, of course, now I’m finding out that when I was in High School we all were buck naked and ran around in the shower and snapped towels at each other, and then it was thought of as nothing. Now, I guess it’s people are not exposed as much as they used to be.
But the idea of the nipple is difficult for a lot of boys, so you need to be able to say. “Well, we’ll check it again,”

The parallels between the cases are vomit inducing. There's so much evil to spread around...

Evil Breeds Evil

There is something very wrong with people.

We seem to collectively want to turn our heads and deny horrors when they happen around us. There is evil stalking us, and we let it in to invade any shred of reasoning capacity we may have, we celebrate its very existence, rather than face it down, and stop it.

To be sure, the real evil takes up housekeeping in the empty husks of bodies that were intended to house human beings. Creatures like Jerry Sandusky and, indeed william ayres, roam the earth, creating suffering and damage that will perpetuate itself, generating fresh fodder for further exploitation and damage.

Sandusky of course, is the Penn State assistant coach who established “The Second Mile,” a charitable foundation to help provide “care” for foster children, and who now stands charged with anally raping a ten year old boy in the college facilities. There are at least 8 people who have officially come forward as victims. I would be shocked if his body count was NOT in the hundreds. It has been widely speculated (with good reason) that Sandusky founded the charity to help him obtain victims.

But here's the rub:
Penn State had a whole host of management who could have put a stop to the evil, but instead, they looked evil square in the eye, and invited it in to their house. It started with Mike McQueary who claims that he actually witnessed Sandusky anally raping a young boy in the facility’s shower.

Here’s what one of the mothers of the victims had to say about Mike:

“I don’t even have words to talk about the betrayal that I feel,” said the mom of Victim Six. “[McQueary] was a grown man, and he saw a boy being sodomized ... He ran and called his daddy?”

After Mike called his daddy, likely already fearful (and possibly advised by daddy) of the prospect of seeing his own career besmirched for reporting the beast, he again failed to do the FIRST thing he should have done: either beat Sandusky to death, or call the cops.

Instead he talked to other coaches, who talked to other university officials, and none of them had the courage to do the right thing. They all stared into the headlights of their precious careening reputations, and now, instead of being heros, the likes of Penn State athletic director Tim Curley, Vice President of Business and Finance Gary Schultz, coach Joe Paterno, and Penn State President Graham Spanier are just another line of cowards who gave up a bit of their soul in exchange for the privilege of running defense for tangible evil.

And we get to watch the evil continue to infect and infest, as dim-wittted Penn State students rally, and even riot on Paterono’s behalf, showing evil support for a coward too blinded by his own fame to see the damage he’s let be done.

As the rioting in Paterno’s behalf started, he made some statements:

He told a crowd of supporters: "Pray for the [sexual abuse] victims," he told the crowd. "We love you."

BUT: He also issued a statement, obtained by Fox News, saying that he was disappointed with the board's decision but would have to accept it.

Heroic statement of support and contrition it is not… It just shows that he clearly doesn’t understand the evil that was wrought while he ran defense for the Devil.

The impact that this kind of crime has is very painful and difficult to describe, but Dr. Keith Ablow does a good job of hinting at it in his article in Fox News. It doesn’t deliver the full breadth and depth of the impact, but it touches upon the tip of the iceberg:

When a child is made to participate in a sex act with an adult, it leads to intense feelings of fear and guilt and betrayal, which can easily color his or her entire existence.

These feelings are often suppressed. Hence, they can crop up in devastating ways later on: in the inability to trust any authority figure, in a tendency to avoid feelings at all, in literally slipping away from reality (dissociating), in attempts to suppress memories and feelings using alcohol and illicit drugs, in attention deficit disorder, in major depression, in sexual disorders and in suicide.

The evil persists.

There are similar players in the william ayres story as well:

Family memebers Solveig and Robert ayres, Shrinks Etta Bryant, Robert Kimmich, Larry Lurie, and all of the others who asked for financial support for the Devil himself are all good examples of evil at work, There are others. People who are supposed to defend against evil and alert the public about its reality look the other way, and twist the truth to distract from the damage done by evil.

The stench and decay spreads, and true heros are few and far between.

Evil always has the last laugh. After you willingly sell your soul protecting Evil, it exposes you for what you really have become.

According to the article, McKowan placed Amati Mehler and another person who trained at Judge Baker, Dr. Joseph Mullen, on her witness list for the 2009 criminal trial, but she didn't call them to the stand.

But take my word for it, any "credible" tip that has come in has been looked into. So far, until this particular unattributed blog entry, I have never seen any "independent investigation" that has led to the discovery of an actual witness. For instance, the three (not four) Judge Baker Graduates who would allegedly have debunked Ayres' statements about being trained there--did NOT confirm to the police or the DA what it was alleged in the blogs that they would say. One told me that she had told the reporter who talked to her that she didn't know anything about Ayres and was in school later than him and that although she could say SHE was never trained to give exams, she "couldn't say for sure what his training was." That is NOT helpful. Another one refused to testify and the last one is physically unable to travel and lives in Europe.

Note that today (10/26/2011) is the deadline for william hamilton ayres to be admitted to Napa State Hospital, for an undoubtedly short stay before he is most likely released back into the community; the San Mateo County District Attorney having utterly failed to obtain any significant time in lockup or even registration for yet another child molester.

If ayres does manage to get himself admitted, then by this time next week (November 2nd, 2011) he will be receiving his $750,000 in bail money back.

San Mateo County - Come have sex with our children!

Armando Lopez-Galvez

It seems that Armando Lopez-Galvez likes to have sex with young girls. Good thing he lives in Redwood City, which is part of San Mateo County!

He was apparently able to enjoy a young girl, and when the Belmont Police caught the man and told the San Mateo County prosecutors about 5 or six months ago, they reacted swiftly, and with great focus to make sure that the disruption to the poor, misunderstood man's life was minimized.

Between the San Mateo County DA, and the San Mateo County judges, they managed to bargain the fine citizen's charge down to a no-contest plea on only one count, sparing the man from potentially serving 10 to 12 years in prison on multiple charges.

They managed to get him down to a 308 day sentence with credit for time served! He does have to suffer through 3 years of probation, and will have to refrain from contacting the young girl, but thankfully, and as per usual, San Mateo County will NOT be burdening him with having to register as a sex offender. The County understands that a man should be able to violate 13 year old girls if he needs to!

If only the Belmont Police would quit pestering citizens who want to have sex with children, then the County would finally have some peace!

By the way, AS USUAL, The San Mateo Daily Journal seems to confuse the phrase "illegally fucking children" with "sexual relationship." Talk about being a mouthpiece for San Mateo County's strange predilections.

DA Backtracks on ayres Lockup Delay

There is a new article in the San Francisco Examiner about the delay to william ayres' commitment to Napa State Hospital to "treat" his alleged dementia, which allowed him to escape retrial on charges that he molested many young boys under the guise of providing psychiatric care.

The news article talks about the fact that prosecutor McKowan made one claim to the press -- The Court didn't provide necessary paperwork -- while DA Wagstaffe made an entirely different claim about availability of bed space. It also mentions that the DA claims that the judge denied a prosecution request to lock ayres up while awaiting a bed at Napa State. (How did Wagstaffe know that this was requested, if he didn't know that McKowan had claimed that the court was responsible, or that the judge had threatened contempt?) The article also repeats the 11-1 guilt vote on ONE charge for the criminal trial, even though news stories at the time reported that this was the case for SIX of the charges.

NOBODY seems able to get their story straight. At least they could all make an effort to tell the same lies.

Analysis of ayres News Story

The Mercury News printed an article last night (Wednesday 10/5/2011) about the ayres hearing this past Monday which allowed the delay of ayres' commitment to Napa State. The Mercury News article can be found here.

The article mentions that the reporters talked to prosecutor McKowan, and apparently, she indicated to them that the reason for the delay is that the court did not submit all of the necessary paperwork.

The Mercury News also mentions that the original criminal trial, which ended in a mistrial, had ONE count that had an 11-1 for guilt vote.

Here are some problems with the news story:

Mistrial Vote Count: Immediately after the criminal trial (in June/July of 2009) there was some confusion in the press about what the actual jury vote count was. This was mostly cleared up after a day or so, with perhaps some minor discrepancies on the outlier votes. By August 4, 2009, the dust had mostly cleared and the final count, as best we could tell from multiple news sources was:

On 6 counts the vote was 11-1 in favor of conviction.
On 1 count the vote was 10-2 in favor of conviction.
On 2 counts the vote was 7-5 in favor of conviction.

I'm not sure why the press keeps incorrectly downplaying the vote count. They do the same thing with the number of times the trial dates were missed, even though their own papers posted a blurb each time the trial dates were re-scheduled due to some stupid excuse or other. (Not to mention the handy guide I've provided) Frankly it's maddening.

Missing Information: The Mercury News fails to mention the judge's statement that if ayres is not in lockup by the new date (Wednesday, October 26th, 2011) that someone would be found in contempt of court.

We're not 100% clear ourselves who would be found in contempt. The parents of a victim were in the courtroom, and they reported the information to us (apparently there was NO PRESS present). The parents indicate that it was Napa State that would be held in contempt, but that there's a possibility that it might have been ayres or McDougall that would be held in contempt, they weren't entirely clear.

Either prosecutor McKowan didn't tell the press about the contempt order, or perhaps the press didn't find it interesting enough to print, but I have a problem with that too....

Further: At last Monday's hearing, Judge Grandsaert ordered the defense attorney to make sure that the paperwork was properly provided to Napa State so that ayres could be in lockup by the new October 26th deadline. Which would lead me to believe that it was, in fact ayres and/or McDougall who would be found in contempt if ayres is not locked up by the new deadline.

Point: The fact that a contempt charge possibility was discussed by Judge Grandsaert at all is very problematic for McKowan.

Logical holes: If McKowan was the source of the information that the delay was because the court failed to provide the necessary paperwork to Napa State, then the whole question of a contempt order becomes a thorny logical problem:

IF McKowan told the press that the Court was responsible for the delay THEN it doesn't make ANY sense for the judge to have had ANY discussion of contempt. The press should have asked McKowan: "Why, then would ayres or his lawyer -- or even Napa State for that matter -- be held in contempt if ayres does not report by the new date." THEREFORE it doesn't make sense for McKowan to claim that the court was responsible for the delay, and I would argue that this is some kind of misrepresentation of fact, deliberate or otherwise... And the press should have pointed this out to McKowan (or whoever their source was.)

UNLESS Judge Grandsaert was saying that the COURT would be found in contempt if ayres isn't admitted by the October 26th. date (Because the Court was late in providing the paperwork.) BUT: it seems silly that the court would warn itself about the possibility of contempt against itself, AND it doesn't make any sense anyway, because the court ORDERED the defense attorney to make sure that the paperwork was submitted to Napa on time for his conviction.

The Good Lord knows, I certainly find the court in contempt, but I suppose that's irrelevant.

The simple statement that the Court was responsible for the delay should have opened a whole line of other questions for the press, but it apparently was lost on them... They seem incapable of understanding that they are being deceived.

Interesting that McDougall never has any comment for the press in defense of his client. He doesn't need to make any; the DA seems to be doing a pretty good job of covering for ayres at the expense of the court (If indeed, the statement that the Court was responsible came from McKowan.)

Even More Delays

Today, the court was informed that, shockingly, Napa State does not have all of ayres' paperwork, and therefore he can't be committed this week, as previously ordered by the completely emasculated San Mateo County Court.

[NOTE Correction: contempt would be against NAPA, not ayres.]

The judge asked McDelay, ayres' asshat attorney, to contact Napa. On 10/26/2011, the judge will allegedly enter a cause for contempt of court charge against Napa State if ayres doesn't get checked into Napa Lock-up by then.

No idea what this means, or why Napa should feel threatened by Grandsaert. Seems like more Grandsaert/Wagstaffe hand-wringing and arm-flapping to distract from the fact that San Mateo county is entirely disinterested in getting child molesters off the streets.

On 11/2/2011, the molester and his dipshit wife will get their $750K back (assuming he's checked into Napa) so they can pay their blood money to all of their marginally ethical turd attorneys.

Maybe then, they can go out to lunch with Larry Lurie and Robert Kimmich, and joke about how funny it is for ayres to molest little boys and then carry on about duping the courts with claims of Alzheimer's. Aren't past presidents of the Northern California Psychiatric Society a hoot?

There is an unexpected hearing listed as a "Status Hearing" scheduled for MONDAY, October 3rd, 2011 8:45am for william hamilton ayres, accused of molesting many young boys under the guise of providing psychiatric care.

ayres, the one time president of the American Academy of Child and Adolescent Psychiatry has been stringing the courts along for more than 4 years, ultimately avoiding prosecution by convincing the San Mateo County District attorney that he is incompetent, in spite of the fact that two of three court appointed evaluating doctors found him to be competent. (The other doctor also originally found him to be competent, but changed her mind on the day the competency trial was set to begin.) But YOU can decide for yourself. ayres Fiasco Makes Front Page Examiner

The ayres commitment fiasco has now made front page news in the San Francisco Examiner, in a story by Mike Aldax. The story talks about the delay granted before commitment, and it also discusses a newly developing angle that ayres has to take care of health issues before going to Napa State (if indeed that ever actually happens) This is not something that was made clear in the courtroom, but apparently Karen Guidotti - the prosecutor's supervisor and chief deputy to DA Wagstaffe - told to the press at some point.

The three ring circus of different stories from the DA continues...

Significantly, the article discusses some of the human damage that ayes has caused to his victims, including alcohol and drug abuse, dangerous behaviors resulting in the death of some victims, and indeed, deep depression and even suicides.

Meanwhile stories are now in many papers and other news outlets all around the country. Many tell the same, or slightly modified versions of the Mercury News story released to the Associated Press:

Napa on October 6th. 6 months likely

On September 7, 2011 william hamilton ayres had a placement hearing to establish the "treatment" he would receive for the dementia that he claims is preventing him from defending himself against charges relating to his molestation of many young boys, while they were entrusted to his "care" for alleged psychiatric treatment.

Last month, in a hearing with an un-announced time change probably designed to prevent the public,the press, and a county supervisor from witnessing the spectacle (and reporting it without the approved Wagstaffe Spin), the DA caved in and conceded to his claims of dementia in spite of the fact that two of three neutral, court appointed shrinks state that he is competent. (The third mysteriously changed her report moments before a competency trial was to start.) And in spite of the fact that the DA was presented with privately funded surveillance evidence that the molester ayres is out and about acting very competent, and even joking about his "dementia" claims with shrink pals Robert Kimmich and Larry Lurie, who has published a paper on Alzheimer's related dementia and its symptoms.

Prior to today's hearing, the DA and the prosecutor told several different stories about what was expected in terms of placement (As many as seven different stories if you count different press reports and reports from victim's families.) These ranged from minimal outpatient care locally, to permanent lockup (unless conditions improve) in state mental health facilities.

Today:

At 9:00am, the prosecutor, the defense attorney and Judge Grandsaert quietly discussed the fact that the court needed to hear information on a few other cases first, so they delayed the start time slightly. The Judge was overheard discussing the importance of the start time, and all three appeared to be amused with themselves and had a little laugh about the distress they caused at the last hearing. (Must be sweet to be an impartial judge.)

Once things got underway, Grandsaert mentioned ex-parte information received from a non-involved party, (We can safely assume that this is private investigator’s report.) He stated that it was non-admissible and possibly unlawful for him to review, and that it can’t be taken into consideration. (NOTE: Technically, Grandsaert is just blowing smoke up people's arses here... the information was provided to all sides, and thus, it is not ex parte. )

Grandsaert stated that if the public is not happy with their officials, then they should change their officials at election time. (Grandsaert was apparently already pissy because a bunch of the people from the un-related preliminary hearings didn’t show, didn’t do what they were told, etc…) The judge is right: the public has to decide if they want to keep bending over and letting people like him blow smoke up their asses or not.

Once Grandsaert stepped down off his lectern, McDougall, the defense weasel, indicated that he wanted a delay before commitment (we think he was asking for 90 days.) He submitted a report from Amanda Gregory, stating that it agreed with findings from Kirshner, (who felt that ayres’ condition was likely Alzheimer’s disease.) McDougall wanted it to be part of the record for “future hearings.” McKowan agreed to making it part of the court record, the judge agreed that the documents were relevant.

Discussion then centered around 1601A, which has to do with mandatory 180 day locked-up commitment in cases in which people have been harmed by a defendant who is claiming incompetency, insanity etc. McDougall seems to have had some alternative to Napa State in mind, but McKowan argued that there were no such alternatives with the required lockup indicated in McDougall’s report, and that if another facility were to accept him, they could lose their license (in light of 1601A) and therefore there were no alternative locations.

McDougall wanted a delay to make sure that paperwork was in order and properly accepted by Napa State before commitment. (I guess he learned from the Youshock snafu.) McKowan wanted ayres to be remanded to Napa today, and said that there was no basis for continuation.

McDougall seemed agitated about statements that McKowan made “outside of court” about Napa having all the information that they need, and insisted that it would not be right to transfer ayres today.

The judge ruled as follows:
The parties have 30 days to get paperwork to Napa and accepted by Napa doctors, (that they have the ability to accept and treat ayres) (9/8/2011 NOTE: According to the San Mateo Daily Journal, DDA Karen Guidotti is claiming that this 30 day delay is so that ayres' can deal with "his myriad medial issues." However, people who were at the hearing did NOT report this as the stated reason for the 30 day delay. Guidotti appears to be a bit of ditz though, having warmly greeted one of the parents of victims - who she had recently had a contentious meeting with - asking gregariously: "How are you doing!?" immediately after Guidotti's employee McKowan had just conceded ayres' incompetence at the start of the August 22nd competency re-trial. In either case, we now have yet another story from the DA's office about what's happening with ayres, and, as several people have pointed out, it's entirely feasible that "medical issues" are yet another loophole that the ayres/DA folks are working on to keep ayres out of lockup.)

Ayres is to be committed to Napa State on October 6th, 2011.

Hearing on October 13th 2011 to exonerate ayres’ bail, once notified by Napa that ayres is locked up and in treatment.

Report is due back from Napa in 90 days. (Not sure what the point of this report is.) (UPDATE: Joshua Melvin at the Mercury News reports that there may be some potential that at this point, if the doctors report that ayres is incurable, that he may then be eligible for a hearing to place him in some other care facility, potentially cutting his stay in Napa from 180 days to 90 days. )

Ayres must be locked up for 6 months. If the doctors decide he is competent after 6 months, then the DA and court can decide if they’d like to have a criminal re-trial. If the doctors decide that he’s still incompetent, then there will be another hearing to determine ayres’ placement at that time. The law does not appear to require indefinite lockup. (But also, note the update on the 90 day report from Napa...)

The hearing wrapped up at about 9:30am, so given the delays to the start of the hearing, it took about 15 minutes.

IMPORTANT NOTE: Several of us think that there is enough wiggle room in Grandsaert's ruling (Napa's review of the report to see if they're going to be able to "treat" ayres, the 90 day review, etc...) and with reports that getting a bed in Napa is very difficult, that it is fairly likely that ayres will never get to Napa, and that he'll end up with some other alternate arrangement. So please don't bank on even this insignificant incarceration as any kind of consolation.

Additional information:

McDougal also fussed over a 2005 case, the “Vargas” case, and/or a related 2010 case that has not been published yet. As best I can tell via Google searches, this appears to be a reference to the Vargas case in Fort Bragg, in which a man killed the man who molested him as a child. After the boy was molested, as an adult, he allegedly became the “lover” of the man who molested him. There is another "Vargas" molestation case in which a girl was molested by a man who was known to be a molester, but the details were somewhat convoluted... Both cases seem to discuss consent issues, essentially relating to the defense trying to shift some of the blame to the victims because the defense claims that they, as adults, or their adult guardians made the decision to put themselves at risk. Not sure what this was all about, or if one of these are even the correct “Vargas” case, but regardless, McDougall appears to be maneuvering to protect his child molesting client from further criminal/civil lawsuits by entering all of this detritus into the record.

Rant:

By the way, the court and/or the DA's office has been looking at the blog all morning since the hearing, so I'll take the opportunity to say that I think it's pretty lousy that you all (including the court) didn't look a little harder at the conflict of interest you have, given the long incestuous relationship you've had with the molester.

I'll add that Grandsaert's slap in the face to the frustrated victims and their families by suggesting that their only recourse is through elective process is only exacerbated by the fact that the public finds this kind of crime too icky to focus on, and therefore any kind of public uprising, no mater how justified, is unlikely to happen. This kind of cheap shot is about as clever as the tactics of a schoolyard bully, and you should be ashamed of your performance today, Grandsaert. Time to grow up.

Times Calls ayres Retrial Hearing "SUSPICIOUS"

The print edition of Saturday, August 27, 2011 San Mateo County Times has the following headline:

"Court in Session... A Little Early: Time of Ayres' retrial hearing is suspicious"

The article, a brief "Insider" blurb that got top billing on the paper calls attention to an important issue that I had originally missed. When I first reported on the August 22 hearing, I did not notice the TIME that I got reports from people at the hearing. I heard from them at about 9:10am. It was actually finished BEFORE the scheduled 9am start time.

Here are some snippets from the San Mateo County Times Article:

District Attorney Steve Wagstaffe said the hearing in San Mateo County Superior Court Judge John Grandsaert's courtroom would begin at 9 a.m. Grandsaert himself listed the time of the hearing as 9.

So the Insider, and Supervisor Dave Pine, were a bit surprised to learn, when they arrived at 9, that the hearing was already over. It had begun at 8:45

The reporter in the Times goes on to call the behavior fishy, talks about Wagstaffe's excuse, and sarcastically chides Judge Grandsaert's questionable decision.

San Mateo County DA Fails Child Molest Victims

In the matter of the criminal and competencey to assist in defense case against william hamilton ayres, former president of the American Academy of Child and Adolescent Psychiatry and prolific child molester:

Deputy District Attorney Melissa McKowan stipulated incompetency this morning, indicating that doctor reports show that his "borderline" incompetency will not improve.

Both McKowan and the child molester's attorney were in agreement to proceed with a placement report.

The judge ordered that the Golden Gate Regional Center should create a report recommending placement in a state hospital or otherwise, and should be provided with reports from both prosecution and defense, and that the report should be prepared by August 30, 2011.

There is a placement hearing at 9am on September 7th, 2011.

Criminal Proceedings are Suspended.

Solveig Ayres smiled broadly at the parents of victims as they entered the courtroom.

Karen Guidotti greeted one of the parents warmly after the extraordinarily brief hearing, stating that she knew her and asked in a very light and happy fashion how she was doing. Needless to say, she got an earful.

Note that DA Wagstaffe made repeated promises that it would be Napa or competency trial.

We have identified the two other men who were dining with william and Solveig ayres on the 18th, who Solveig refers to as ayres' "very, very good friends." (Whatever THAT means...) They are, as we expected the second we saw this video: Larry Lurie, M.D., and Robert Kimmich M.D, both San Francisco shrinks and past presidents of the Northern California Psychiatric Society, a pathetic organization from which a great number of past officers were signatories of a letter pleading for financial help for child molester ayres while he was on trial. Lurie is sitting immediately to william ayres' right, and Kimmich is sitting to Solveig's left.

According to the Private Investigator's report, this lovely little bunch of lunch buddies had a good chuckle about ayres' incompetency gambit during their little lunch break:

"Both men spoke about the effects of Alzheimer’s and the unidentified man said that its only benefit was that “you can mention it in front of the lawyers ‘case it’s serving a purpose” which was greeted by laughter from all seated at the table.”

Lurie should know about Alzheimer's: He's been writing practice guidelines too... wonder if there's a chapter on what the symptoms would look like, for example, if you wanted to make it seem as if you're symptomatic? Why yes, there certainly is!

It's interesting that Lurie is such great friends with ayres, who claims that he was "trained" to give "physical exams" to children in treating them. After all, Lurie says THIS when comparing his hobby of sculpting to treating patients:

The “tactile, hands-on” nature of this art form is particularly intriguing to him, Lurie noted. “I had thought of becoming a surgeon, but didn’t feel I had the skills, but even thinking about that specialty must have meant that I like the touching aspect. Psychiatry, in contrast, is so hands off.”

Even "very, very good friend" Lurie exposes ayres' lie.

Clip One: The ayres vehicle and residence under surveillance, and william ayres in his vehicle being driven by Solveig Ayres, ayres is wearing his usual "disguise" of a baseball cap and dark glasses. He has been spotted this way by many people, sometimes with his walker, sometimes with only a cane.

Clips Two and Three: william and Solveig went to lunch at La Vie in San Francisco on August 18, 2011 with a pair of as-yet-unidentified men. They had detailed discussions, and ayres himself dominated the conversation for at least 20 minutes.

These surveillance videos show many aspects of william ayres' behavior and the other people’s reactions to his behavior that appear to indicate very little cognitive impairment.

Natural behaviors:

ayres clearly points to his chest when referring to himself in conversation.
Other guests nod and react normally while ayres is engaging them in conversation, and his gestures seem appropriate, the guests react as if they are normal aspects of conversation.
ayres is aware and acts appropriately when one of the lunch guests leaves early.
ayres subconsciously moves the dishes around to make room when the meal arrives, while engaged in the conversation.
ayres subconsciously uses his napkin when necessary and at appropriate times.

Active engagement:

ayres is clearly directing/dominating the conversation for a good percentage of the time. (About 20 minutes.)
ayres shows emotional/animated responses to the conversation.
ayres directs the waiter in placement of the drinks when they arrive.
ayres catches the waiter’s attention to let him know that they are wrapping up, and asks the waiter to bag some of the food to go.
ayres uses his chopsticks for a good portion of the meal, after which the novelty appears to wear off (as is the case for other members of the party.)
ayres frequently makes humorous comments which the others react appropriately to, and laughs on cue when others say something humorous.

The Surveillance Report:

We can't stress this enough: we understand that the DA intends to concede that ayres is incompetent to defend himself at trial, and give him a slap on the-wrist, temporary commitment. The standard for incompetence is normally VERY strict, and we do NOT believe that this proof has been met, and in fact we believe that ayres is being deceptive about his level of competence. We think that this evidence clearly shows that ayres is much more competent than not. If you agree, please let the DA know before Monday!

We are distressed that the DA appears to not be swayed by this new evidence.

We have identified the two other men who were dining with william and Solveig ayres on the 18th, who Solveig refers to as ayres' "very, very good friends." (Whatever THAT means...) They are, as we expected the second we saw this video: Larry Lurie, M.D., and Robert Kimmich M.D, both San Francisco shrinks and past presidents of the Northern California Psychiatric Society, a pathetic organization from which a great number of past officers were signatories of a letter pleading for financial help for child molester ayres while he was on trial. (Lurie was also the author of the lovely letter)

Lurie is sitting immediately to william ayres' right, and Kimmich is sitting to Solveig's left.

Lurie should know about Alzheimer's: He's been writing practice guidelines too... wonder if there's a chapter on what the symptoms would look like, for example, if you wanted to make it seem as if you're symptomatic? Why yes, there certainly is!

Keep this in mind when thinking about ayres' alleged incompetence:

1) ayres' primary care physician, Dale Ritzo, put ayres on Aricept for treatment of Alzheimer's (or the dementia related to it) but ayres didn't take to it, so they took him off of it.

2) In July 2010, ayres had an MRI that showed minimal shrinkage of the brain, normal for his age, and it did NOT show "white matter" that usually shows up in Alzheimer's patients.

3) ayres got a 26 out of 30 on his first mini-mental state examination (MMSE or Folstein test) but the second time he took it he scored 29 out of 30. According to published information, a score of 25 or better is considered to be "normal" The scores normally trend lower over time in an Alzheimer's patient.

It's interesting that Lurie is such great friends with ayres, who claims that he was "trained" to give "physical exams" to children in treating them. After all, Lurie says THIS when comparing his hobby of sculpting to treating patients:

The “tactile, hands-on” nature of this art form is particularly intriguing to him, Lurie noted. “I had thought of becoming a surgeon, but didn’t feel I had the skills, but even thinking about that specialty must have meant that I like the touching aspect. Psychiatry, in contrast, is so hands off.”

Even "very, very good friend" Lurie exposes ayres' lie.

There was a "status conference" today that we were not aware of ahead of time. My last check was last Thursday, and the court clerk reported no change at that point, so it must have been scheduled Friday or Monday.

There is ANOTHER Status conference scheduled for NEXT MONDAY, August 1, 2011.

One of the parents talked to office staff at the DA's office today. Staff checked the notes and indicates that the conference today and the one scheduled for Monday were to make sure that things are still "on track" for re-trial of william ayres' in the matter of his competency to defend himself against criminal child molestation charges.

As of this afternoon, anyway, the August 22nd competency re-trial is still scheduled.

As mentioned by Joshua Melvin in the Mercury News, the DA may be making some kind of determination this week as to how to proceed in the competency and criminal case against william hamilton ayres for his molestation of many young boys.

As of early this afternoon there doesn't appear to be any further information that has been announced or discussed, so far.

If we find anything out, we'll post it here. I know everyone's a bit on edge.

Joshua Melvin has published a new article in The Mercury News.

It seems that although the competency re-trial is scheduled for August 22, the DA will be deciding the week of July 18th if they intend to just accept ayres' "incompetence" claims.

As per usual, ayres' asshole defense weasel has "no comment" about the blood money he is accepting from ayres, who charged parents for the time he spent molesting their young boys. ayres may also have received money to assist in his defense from any number of dipshit sham shrinks in the area (like these incompetent, quack shrinks).

The asshole defense weasel supports his family with money that is earned via the pain of victims all over.

Competency Mis-Trial Status Conference

Today's Status Conference Results:

The attorneys showed up at 8:45, disappeared into the judge's chambers for a few minutes, and then left. According to the bailiff, there is no information other than that the August 22 trial date stands, and nothing will be discussed in open court today. The bailiff apparently didn't have many other specifics.

There might be more to the story, as the court started watching this blog at 8:46AM, and has viewed the blog several times since then (seven times). Perhaps the news folks will talk to McKowan about behind-the-scenes discussion and maybe get another juicy "No Comment" quote from McDougall.

There will be a conference on Wednesday, June 29th at 8:45am to discuss next steps for case of william hamilton ayres, alleged psychiatrist, who molested many young boys under the guise of providing psychiatric care.

On June 17th, mistrial was declared in ayres' sham competency trial. The court has set a re-trial date for August 22, 2011, but there is a status conference on Wednesday, at which point this may change.

From discussions in court and in the paper, it seems that they may not go ahead with a re-trial for the competency portion of the case. Even if they do have a trial and determine that he is competent, there seems to be indication that there will be no criminal re-trial, and if he is found incompetent, he may get "outpatient" treatment.

At this point it's looking very much like ayres will walk, even though he's a habitual molester, and has been for many years.

Today's Hearing to Determine Future of Ayres case: No Decision Made Today

I don't have full details, but a parent of a victim who attended this morning's hearing says that no decision was made today about a retrial for Ayres' mental competency. Another hearing on this matter is set for this Wednesday, June 29.

While a date of August 22 was discussed among the attorneys for a retrial of the competency, prosecutor Mckowan told the mother of the victim that "there probably won't be another criminal trial."

Coincidentally:

Yesterday in Delaware, the notorious pedophile pediatrician Dr. Earl Bradley who was indicted in February 2010 on 470 counts of raping and molesting children was CONVICTED yesterday - a mere SIXTEEN MONTHS after the indictment.

The Profession

I've read some of the comments over the last few days, and frankly, I'm a little disappointed about some thing that you be surprised that I'd be disappointed about.

I've thought about not even posting my thoughts on this, because, in a sense, I'm "biting the hand that feeds me" (again).

There have been posts by a few people who claim to be shrinks, both here, and in the San Francisco Chronicle comments section. They express empathy to the victims of ayres, and they mention that ayres "Disgraced us all."

To be sure, I would STILL like to hear others in the profession comment on this, but what I REALLY want to know is: Where the hell were the comments like this BEFORE there was precious little chance of any conviction, and when speaking up might have made you a little out of place with your colleagues?

I can think of only a very small handful of people who were ASSOCIATED with ayres in the past who spoke up BEFORE or during the criminal trial, and one of those few was a judge, so doesn't really count. There is a laundry list of shrinks who sent out requests for support of ayres legal woes. ( some of them are pictured above) and one has supported ayres in public ( Etta Bryant).

But few have spoken up to clarify that:

A) It is a sham that ayres was claiming to do physicals. ( These were NOT physicals.)

B) Psychiatrists don't do physicals.

Where are all of you, why aren't you being vocal? You're complaining about your profession being disgraced: if you really care, then why didn't you speak up when it counted? If 50 shrinks in the bay area had stated in the press that this claim was bullshit, there would have been public outcry at the outcome of the first trial. If you had hounded the DA and the press about this "Disgrace" BEFORE the first trial, you all could have saved some of the disgrace brought to you profession.

You didn't.

When I spent years in therapy as an adult, wanting desperately to talk about the problem, and while displaying classic symptoms of an adult who had suffered child molestation, I was never asked once about where those symptoms might have come from. I was dying to be asked, and no shrink ever did.

I don't know that there's much disgrace left for your profession to suffer.

Well, so much for gratitude, right? I guess as this drags on and on, I have very little grace left in me. But at least I'm growing a pair of balls.

The statement 'He cannot be retried on the criminal charges until he's deemed competent' is a false statement. He will or will not be retried solely on the determination and decision of the DA's Office.

The fact of the mistrial on incompetency will raise issues on appeal. That will be the DA's concern.

Further, in spite of the utterly unusual events surrounding the declaration of mistrial and the basis for it, not one word of comment is made by the reporter on this subject. Why?

How often does such a high profile case terminate its deliberations so quickly? Yet not a word from this person reviewing the event.

Further, although on-site observers of the trial are unclear as to whether there was a public hearing of the mistrial event, as has always been the case in my experience, there appears to be the possibility that the entire event was conducted in private. This would be extraordinary if true, and certainly newsworthy.

We all know from having seen events like this repeatedly, that it is common practice for a judge to admonish the jurors, consult and advise them according to the law and send them back to try again time and again. Yet, in this case, the judge seems eager to accept the mistrial path and waste the taxpayer's hard-earned money. Why?

None of these issues are addressed by the reporter and editor who seem to my mind intent on creating misinformation in an attempt to mislead the public. If this is the case, it is reprehensible and irresponsible in the extreme.

There has already been a long series of events in this case of questionable actions and behaviors on the part of both Bay Area News Groups characterizations in their reporting of this horrid trial, as well as those of the DA's Office and the Courts in the conduct of this case.

Does Dr. Ayres have knowledge of the conduct of others within the government and judiciary of the County of San Mateo that requires those in power to take steps to collaborate in efforts to protect him from the obvious consequences of his actions? One can only speculate..

Competency Trial - Mistrial Declared

According to the San Francisco Examiner, DA Wagstaffe has indicated that:

The case will continue next week, when the judge and attorneys will decide whether to retry the competency issue. Otherwise, Ayres is considered competent.

On the flip side, Joshua Melvin's article in the Mercury News indicates that prosecutor McKowan and Defense attorney McDougall will meet in court on Friday, June 24, 2011 to decide what to do next.

Further, Melvin's article indicates that:

If prosecutors decide against a second competency trial, it could mean the end of the case against Ayres. He cannot be retried on the criminal charges until he's deemed competent.

There seems to be some conflicting information out there, but I think that it's likely that the story in the Examiner is either misquoting DA Wagstaffe, or Wagstaffe was just puffing up after a blow. Melvin seems to pay pretty good attention to these kinds of details.

On a personal note: I'm obviously very upset about the outcome ( As you can tell by my comments immediately after the post of this article. ) I've had it with all of the parties involved, and the continual delay tactic of the defense is holding grievous old wounds open. I'm not sleeping anymore and my health is poor.

In the past, I've switched between leaving comments open and moderating them first. Every time there is a setback, a select few people come out of the woodwork to attack me, a victim of william hamilton ayres, for stating my mind openly and frankly. They all fit into the category of either family and friends of the soulless subhuman ayres, or they are sick individuals with problems on par with ayres'.

Competency Trial Day - Day 9 - Deliberation

9:00AM Jury is scheduled to resume deliberation.

11AM Court clerk indicates jury is still in deliberation.

2:00PM Clerk reports that the last entry shows the Jury went to lunch. So no verdict yet.

3:00PM Jurors seen on break, back to work at 3PM.

4:00PM Michael Stogner reports that jurors are still at work, and appeared relaxed and seemed to be getting along with one another. Court clerk line is now closed, If we are able to hear more from Mr. Stogner, we'll relay it to you.

Over and over and over and over again, he demonstrated willingness to participate in Evil.

ayres is an empty husk, a bankrupt proposition: devoid of value. his life has long since been forfeit.

Personally, I hope the weight of the lie in McDougall's statement does not press on the hearts of the jury. They too, are innocent bystanders burdened by the evil that william ayres has wrought.

Competency Trial Day Eight - Brief Updates

Trial Day Seven - Letter from Parent of Victim

There is a new post from Wednesday's court proceedings below this one. I got this letter from a parent of an ayres victim tonight. (Thank you for this letter. It is very meaningful.)

I am the mother of one of ayres victims, a victim who has nothing to gain by this fiasco other than to hopefully see the truth be told and justice served. A real long shot.

Ayres is guilty of the charges against him. Ayres is the most vile subhuman. He was trained in an esteemed profession, he took an oath to do no harm, he then used his profession to impose his perverted prurient interest on the most innocent among us. He has victimized helpless children, not adults whose psyche's are formed. He has victimized innocents who had no way to protect themselves. He continued with his victimization knowing full well the damage he was causing, interfering with the normal healthy development of these children. He has left horrific scars on countless victims. He is responsible for all of this. That is his legacy in life -- He has harmed innocents.

For ayres to profess to be innocent is a joke. He is as guilty as they come. He deserves every bit of the inconvenience that these legal cases have caused him in stress, depression, financial loss. He is worse than worthless.

For any professionals who have supported ayres, who have believed him, I say that you are sadly mistaken. You need to look at yourselves and ask why you are so blinded. What are you afraid of? Does the fact that he fooled you make you question your own competence? It should.

He is guilty.

Competency Trial Day Seven - Prosecution Cleans Up!

Today, Paul Good Ph.D took the stand for the prosecution.
Good was one of the doctors appointed by the court to evaluate ayres for competency well before the competency trial.

Good was professional, credible, and a VERY strong witness overall. He flat out stated that ayres is competent, and he left little room for doubt. Defense attorney Jonathan McDougall poked, cajoled, and harassed to try to get Good to admit otherwise, but Good simply did not budge in his assessment.

On discussion about one of the tests, McDougall questioned Good on segments of the testing, and was trying to get Good to say that some level of incompetence was shown, and that ayres couldn’t answer simple story questions. Good told the jury that that the story he used in the test was very complex and abstract, and that it is THE most challenging test sample. He said that initially ayres refused to answer questions, and that if those non-answers were scored, he wouldn’t have passed, but Good says that because he knew that ayres is intelligent, he needed to have a challenging enough test to get him to cooperate, and when he actually got ayres to participate, ayres scored absolutely fine on the test. There seems to have been an implication here that the Defense doctors may not have been persistent and patient enough to overcome ayres stubborn refusals, and simply accepted non-response as a failure.

McDougall kept hammering at Good about ayres’ off-topic rambling as was discussed yesterday by the Frumpy Liberal Hippy Ph.D. Good was adamant that these instances were NOT off-topic rambling. He says that ayres clearly wants for his attorneys to understand his points, and ayres is trying to keep these points central to the discussion. Good says that ayres wants everyone to know that he was trained to “examine” young boys and that he does not want to plead guilty because he is not guilty. When his attorneys stray from that topic, ayres is bringing the point to the center of attention again.

Prosecutor McKowan on several occasions asked Good about specific examples from the past that demonstrate that ayres is, in fact VERY competent to remember and process information. (Interestingly, most of these examples seem to also reflect on ayres typical stubborn, narcissistic arrogance.)

Good relayed that ayres sounded mildly paranoid about police and patients, He felt that an officer had lied in order to get a search warrant. ayres complained about Dr. Ponton who testified in the 2005 civil trial and in the 2009 criminal trial against ayres.

McKowan points out that this shows well functioning memory, and it’s also a good example, because Ponton testified that “physical exams” are not standard practice, which causes ayres to laser beam focus on his sore point – his insistence that he was trained to do “physical exams.”

The “training” line of discussion allowed McKowan to discuss the fact that while ayres insists that he was trained to do “physicals,” while McDougall was preparing for the re-trial, he was unable to find a doctor willing to testify to that fact. Even Gil Kliman wouldn’t come back to testify.

Good also discussed ayres being upset about his attorneys. He says that they are deceptive and lie to him. ayres thought that Weinberg was lying to him. Specifically, a plea bargain was discussed in the criminal trial, but ayres claims he didn’t know about it, but Solveig did. ayres insists that he won’t plead guilty to anything because is not guilty. [ NOTE: Joshua Melvin covers this better in his MercuryNews article.]

Good mentioned that ayres complained about a scientologist reporter who had a vendetta against him. McKowan asked Good if ayres had specifically mentioned Victoria Balfour to him. Good said that in fact ayres had: ayres told Good that Balfour got complainants to come out against him and that she has put up a web site against him! At first, Good thought that ayres might have a problem with paranoia, but then Good said that he looked at the blog, and realized that ayres was fine. (I must admit: I very nearly choked to death laughing when i heard this! By the way: Victoria is NOT a scientologist.)

(I’ll take the moment to thank Victoria Balfour for her extensive contributions on my blog. She HAS made it a point to see that an animal who has hurt so many has finally been pushed into the justice system where he belongs. Her fact finding has been nothing short of amazing, and there’s no way I could accomplish what she has. I don’t have the necessary skills, and it’s too painful to keep all the fact straight. So, Thank You! )

ALL of these memories that ayres has recounted demonstrate that he is not at all incompetent. He clearly is able to focus when engaged.

In the afternoon Dr. George L Wilkenson MD, a forensic psychiatrist, testified.

Wilkenson interviewed ayres in January and June of 2011. Wilkensonwas reserved and seemed a bit more casual. He says that ayres IS competent, but that he probably needs some minoraccommodations if he's going to testify, like the use of notes as was the case in the criminal trial, ormore frequent breaks.

Wilkenson related a pair of questions that he asked ayres.In January, he asked ayres if he had any three wishes, what would the be. Ayresanswers were: Legal problems solved, physical ailments solved, all of his lostcash back. Wilkenson said that these were selfish wishes. When he saw ayres inJune, to the same question, ayres replied: Stop wars, Help people be kinder, Asocial justice system. Wilkenson said that these answers show an improvedmental state, and are more altruistic.

Distracting a bit from Wilkonson’s testimony wasthat desperation had already set in, and the Defense team was behaving verybadly:

For one thing, Frumpy Liberal Hippy Ph.D. had remained in the courtroom from her morning cross examination, and was sitting right in the front, disturbing the proceedings with antics that I easily could have predicted yesterday, had I known that she was planning to linger. She rolled her eyes wildly while looking back at Solveig whenever she didn’t like Wilkenson’s answers.

McDougall saw that Wilkenson was using notes, and he took the opportunity to use Wilkenson to show how hard it would be for ayres to use notes. McDougall aggressively would try to hurry Wilkenson whenever he would look at his notes. As McDougall was questioning Wilkenson, Frumpy Liberal Hippy Ph.D animatedly wrote a note on a big piece of paper, and put it up on the rail. Several times when McDougall paced nearer to her, she would wave around to get him to notice her. Finally she passed it over to him like a third grader passing illicit love notes to the class jock.

McDougall then went on the attack: He asked Wilkenson to compare the scores from his test to the scores from the same test that another doctor did. As Wilkenson flipped through his notes McDougall harangued him more. Finally, he said to Wilkenson: “You don’t have alzheimer’s do you???”

Needless to say, McKowan objected to the badgering going on. The judge agreed.

Great job McDougall! You did a bang-up job demonstrating an easy accommodation if the prosecutor is pushing your client too hard. You can just ask the judge to intervene to slow things down a bit. Perhaps you should thank McKowan for helping you with your courtroom style.

The case is rested. The Jury will be given instructionstomorrow at 9am.

The jury was given extra specific instructions aboutresearching the web given the mention of this blog during the trial.

I’m feeling pretty good about having put up my jury warning. I hope they do theright thing.

Funny how all of these lovely Ph.Ds are sucking up to ayres.Maybe no one told them that ayres thinks that they are inferior, and that psychiatristsare better than Ph.Ds

Brief update:

Testifying for the Prosecution is Paul Good. If this is the same Paul Good who I think it is, he is a Ph.D clinical and forensic psychologist. He was paid by the State of California to evaluate ayres. He is an "expert witness on mental state defenses, sexually violent predator commitments, sex offenses, death penalty cases, false confessions, Miranda waivers" according to his web site.

This morning, Good testified that he believes that ayres is totally competent to stand trial. Good is one of the doctors to file the initial medical evaluation reports requested by the court. We don't have additional information at this time.

For what appears to be the first time during the trial, ayres was taking notes.

Afternoon Update:
The other doctor hired by the State to evaluate ayres is now on the stand. I believe his name is Wilkenson.

Competency Trial Day Six - Summary

Some Notes from today's trial:

Please also note that tomorrow may be the last day of witness testimony, and there is very possibly going to be NO coverage Wednesday, so there may be no update tomorrow night. I had early hopes that there was going to be heavier press coverage as there was on the second day of trial, but that doesn't seem to have panned out.

First to testify on day six was Dr. Jatinder Singh for the defense. Singh was one of the first two doctors appointed by the court to evaluate ayres before the competency trial was requested. On the day that the competency trial was to start, Singh mysteriously changed her mind, and thus another delay was achieved for ayres while we waited for a third doctor’s input.

Reports are that Singh’s testimony was less then spectacular, seeming confused and hesitant.

Next up was a woman, a Ph.D. or other doctor and/or professor in the UC Hospital system, possibly a clinical neurologist. My coverage of her testimony starts about mid-stream, and I don’t have her name. I may be able to fill in details later. She looked very much the liberal professor type, long gray hair, frumpy looking, with black/grey/white plaid long dress, and thick framed glasses. My understanding is that she was paid $250 per hour for her evaluation/testimony.

She had some kind of handout, apparently an outline to describe various categories of materials that she has in the past (perhaps for this trial, but not really clear) reviewed and categorized into areas applicable to determining competency with respect to standing trial. (And on, and on, and on, and ON.)

I don’t know that anybody was really following this. Mostly eyes were glazed over. I actually understand some of this stuff, and I was having trouble caring about what she was saying. She very much has the air of someone who IS intelligent, and who knows that she’s better than you are. On several occasions she says that the whole area of competence to assist in one’s own defense is a “new frontier.” She spent most of the time lecturing to the jury, but at the beginning of EVERY shift of the conversation, she would glance over to McDougall to see if he approved of the direction she was taking. On MANY occasions she would stop herself, and wait for the instant that it took for McDougall to redirect her. I’d have said that it was rehearsed, except for the fact that the question if it was OK to proceed was clearly present in her expression.

Whenever the prosecutor objected to a line of questioning, she rolled her eyes as if to indicate that the prosecutor was being ridiculous. At one point the court recorder asked her to slow down, and she immediately shifted her rapid speech to a condescendingly slow gait, even slowly spelling out a three-letter acronym, one-miss-iss-ippi, two miss-iss-ippi, three miss-iss-sippi style.

In spite of the long-winded, and seemingly irrelevant opening, her testimony could be quite damaging.

When she finally got finished lecturing, she stated that ALL of the doctors who have interviewed ayres agree that ayres is suffering a progressive degenerative disease, and that he is NOT malingering, and that he is in fact very motivated to go to trial. She arrives at this conclusion by reading through all of their reports, even though yesterday, some of those very doctors stated that they could not reach a conclusion either way about ayres’ malingering. (So either she is lying, or those who testified yesterday are lying. Or maybe there is just a misunderstanding.)

She then spent a good deal of time talking about the types of reasoning that come into play in determining competency to assist in defense, but never really wraps it up with any kind of definitive statement. She also discussed evaluation methods, and that while they are “open ended” and subjective, there are enough scoring guidelines so that there can be consistent findings.

At one point, she read a statement that ayres made when asked about his prior attorneys. He started with a rant about how they’re all deceiving him, and that they didn’t include him in decision making, and then rapidly digressed into fear of getting a spinal tap, and it got more confusing from there…

She then read from many sections of the transcript of ayres’ testimony in the criminal trial. Mostly from times that he became distracted in his answers, and/or asked for the question to be repeated. She states that this is indication that ayres was having severe incapacity even then.

McDougall asked her if this kind of “forgetfulness” can be explained by being nervous or stressed about the circumstances. She states that this is the “LAST thing I would think of” as an explanation, based on his long career of public speaking. She mentioned his PBS “Sex Ed” program, and an “impromptu” speech that he gave when he was president of the American Academy of Child and Adolescent Psychiatry, for which he received a standing ovation, (etc, etc, etc… ) She spoke very glowingly of him. She spent some time after court talking to him as he waited patiently on the street for Solveig to come pick him up.

The interesting (But probably lost on the jury) part of thetestimony was that she was skipping over the parts of the testimony that mostfrequently seemed to get ayres off track. Prosecutor McKowan objected and triedto have her read the inclusive parts of the testimony, but the objection wasoverruled, with the understanding that McKowan would be able to specify problemareas later (I assume this will happen on cross.)

In short: much of the testimony that the witness chose toread from included discussions of boys genitals and/or discussions of “medicalexams” that were given (She skipped over those parts as best she could.) But Imaintain that ayres was VERY FREQUENTLY off track or off topic, and had to bereminded of the question EXACTLY when the topic of boys genitals came up. It ismy (uneducated) opinion that ayres was distracted by his prurient interest inthe topic, not out of nervousness or any kind of degenerative disease.

After the Defense finished their questioning, the court tooka break.

Upon returning from break, it was announced that McKowanwould not be able to cross examine the witness until later, as another ofMcDougall’s witnesses had a conflict for tomorrow, and would need to testify inthe afternoon.

John Philipsborn, a criminal defense lawyer took the stand next.

McDougall questioned Philipsborn about what responsibility an attorney has with regard to a client’s competence to assist in his own defense. The lines of questioning also focused around Godinez v. Moran. Frequently discussion turned to questions about how to handle clients and their decisions to plead guilty (or not). This was brought up several times in the discussion. It was never clarified if there was a specific reason for this line of questioning, but it did appear to be very central.

McDougall clearly has respect for (or at least feigns respect for…) Philipsborn. Often McDougall would ask an awkward question, and Philipsborn would rephrase the question properly for him and then answer it.

McDougall asked if there were ever cases in which an attorney might raise the competence issues when a previous attorney did not (Answer: yes)

McDougall also discussed jury instruction, and especially with regard to instruction about a witnesses ability to recall aspects of the situation, implying that an incompetent person would appear to be withholding information. The discussion was oddly vague at this point. I assume McDougall intends to tie all of this together in some kind of Perry Mason-like manner.

On cross examination, the prosecutor questioned Philipsborn about the nature of a defense, asking him if at a prior trial based on events of 15 years prior, would it be likely that there would be a strategy change in a re-trial with a new attorney. Philipsborn responded that it was not likely, but that it has happened. Several questions were asked along this line, with all responses agreeing, but with caveat that “it has happened.”

The prosecutor tried several ways to get the witness to agree that it’s possible that in a re-trial an attorney would not need as much input from the client, or that stresses on the client could be mitigated by various means, etc. This seemed to be of neutral success… The witness always seemed to indicate that it was possible, but that there would always be critical decisions (like guilty pleas) that an incompetent defendant should not be allowed to make.

The next line of questioning had to do with loss of memory as proof of incompetence. McKowan used examples that were relevant to the criminal trial, such as not remembering specific details of one event 15 years ago, that was one event of thousands of similar events. The prosecutor was successful with this line of questioning, many times with several examples, Philipsborn agreed without caveat that these kinds of examples do not indicate incompetence. However, after several repetitions of this line of questioning, the witness became wary, and less agreeable, eventually indicating that the memory loss may not indicate incompetence on its own, but that it could be one indication if the client was, indeed incompetent.

McDougall then asked a few more questions. The questions revolved again around decisions to make a plea bargain, and then reversing that decision. Further, at this point the focus seemed to be on cues that a prior attorney missed that a COMPETENT ATTORNEY should have noticed.

There was a sort of dark undertone during the questioning that was implying that Weinberg was not a competent attorney.

Philipsborn's testimony on the witness stand was quite short, and ended somewhat ambiguously. Again, one would have to assume that McDougall will be tying up all of these loose ends that he's left dangling. We have some themes, but no real apparent direction.

At this point the judge stated that as it was getting late, everyone would go home early (about 4:30) and that tomorrow would start with the prosecutor’s cross examination of the earlier witness.

The judge further stated (unless this was misunderstood) that there would be TWO more witnesses, and then the trial would be finished. I can only assume that these two witnesses are the prosecutor’s witnesses.

It seems that the trial will be coming to conclusion very soon. There have been quite a few witnesses stating that ayres is incompetent. According to Mike Aldax at The Examiner, Dr. Amanda Gregory was paid $20,000 to reach this assessment. I wonder if that's how much a soul costs these days?

I can only hope that these facts are not lost on the jury.

Joshua Melvin's story appears in the MercuryNews. Go read it! In the article, Melvin mentions that Amanda Gregory testified yesterday that ayres was upset about his mental problems:

"He didn't want to be found not competent," Gregory said. "He wanted a trial so that he could be exonerated."

My comments on this:

The definition of exonerated includes such language as: "to relieve of responsibility" and "to clear from accusation or blame" A trial will not achieve this for ayres.

A jury finding of "not guilty" only shows that the case was not convincing enough to convict based on information that the jury was ALLOWED to see, and that the jury was PRESENTED with in a way that is convincing (or not convincing) enough.

Unfortunately, a trial will not achieve the "exoneration" which ayres seeks.

ayres will still be morally responsible for the damage he has caused to so many, and the accusations and blame will still remain wholly intact.

ayres has already settled one civil lawsuit for a substantial sum of money. Were ayres interested in a trial so that he could be legally clear of charges, he could have achieved that goal years ago. That ship has long since sailed.

Competency Trial Day Five

Notes from trial day five:

First to testify for the defense today was William Mcmullen, PHD, a specialist in Neuropsychology, head of neuropsychology at California Pacific Medical Center in San Francisco.

Mcmullen saw william hamilton ayres (in August 2009?) on referral from Dr. Telfer who testified last Thursday. Mcmullen stated that the presenting complaint was forgetting names, etc, and further stated that Solveig came with ayres at the time of the appointment, and that she stated that ayres had noticed these problems for the last four or five years. Mcmullen reviewed ayres’ medical history and said that ayres’ history shows a strong possibility that vascular disease is the cause of the memory problems.

Defense attorney McDougall presented a chart with various tests and their scores. Most were normal except tests for verbal memory. Visual memory tests showed good. The report back to Dr. Telfer show that ayres attention was average, language a bit weak, visual/spatial skills HIGH STRONG. It stated that memory and language are the basic problem. The report shows that ayres SUFFERS DEPRESSION. (Cue violins…) The diagnosis was Cognitive Disorder (either vascular or Alzheimer’s)

On cross examination, the prosecutor, McKowan, asked if ayres might be “malingering.” Mcmullen didn’t get that impression. She then asked Mcmullen if he had known about the trial, might he have made the assessment that there was some malingering, but the doctor didn’t go for that… he said that his assessment was clinical and not forensic, and that he didn’t do any tests that would help with that kind of assessment.

Another line of information that the prosecutor pursued related to the timing of the claims of memory loss.

Dr. Mcmullen reported that Solveig said that ayres had been having problems for four or five years, and that ayres himself stated one to two years. There was also some reference to testimony or other court record that shows that Solveig or ayres himself reported only having problems for about a month at the time reported. (The point, I think is that at the beginning of the first trial, memory had only been an “issue” for a short time, but that immediately after the trial, suddenly the problem appears to have been retroactively claimed to be “more persistent.”)

Second to testify today was Amanda Gregory, Ph.D. a UCSF neuropsychologist.

Gregory was contacted January 2010 by McDougall to do an evaluation of ayres. ( IMPORTANT NOTE: I’m not 100 positive about this date.) If this date is correct, then that means that McDougall was well aware of the competency results and had this defense tactic in mind THREE MONTHS before the scheduled start of the criminal retrial. And yet, he waited until the pre-trial hearings to make his claim. Also note that the Defense sealed ayres’ medical records way back in October, 2009 due to a “medical event.”

Gregory wrote three reports after ayres assessment. She reviewed records from a 6/15/2009 report from Dr Firestone, the report from Dr. Mcmullen, an MRI, and information from Dr. Telfer. She met with ayres 3 times in February and March - a total of 9 hours.

She also met with ayres again LAST FRIDAY. Ayres was asked who testified, and he remembered that a doctor testified, but he couldn’t remember who, and that his wife testified, but he didn’t remember what she said, but that he thought she did a good job.

Solveig reported declined memory since 2003 (So now, the story has expanded to 7 or 8 years) Gregory used 15 neuropsychology tests and 3 symptom questionnaires. She said that she gave three tests to make sure that there was no malingering. Her tests indicate the same as Mcmullen’s poor scores on verbal memory, and visual/spatial are good.

Her recommendation was that he see a psychiatrist to get correct medications to treat the condition. She recommended the UCSF Aging Center. He went to Stanford Clinic instead and saw Telfer. Gregory reviewed further information from Dr. Telfer and a Dr. Kirshner. Kirshner put less weight on a vascular diagnosis and more weight on an Alzheimer’s diagnosis.

Gregory flat out stated that ayres is NOT competent to assist in his defense.

On cross examination, prosecutor McKowan pointed out his lucid testimony during the criminal trial. She read many examples from the transcripts that demonstrated his quick and pertinent responses about his past, medical diagnoses that he had made in the past, and quick and even fiery responses on cross examination when pressed. McKowan kept asking Gregory if that demonstrated enough functionality to assist in his own defense, to which Gregory always responded yes, AT THAT TIME. This probably occurred 7 or 8 times during the cross. McKowan also pointed out that the first test showing verbal memory problems was only ONE MONTH after the testimony read, and that there has not been significant decline between then and last Friday.

McKowan asked about tests that apply stringent criteria to make a competency evaluation, and asked if Gregory had administered any. Gregory’s response was that she hadn’t and that she had relied on her own independent assessment. McKowan pointed out that no one else would be able to comment on Gregory’s assessment, since there was no test record to corroborate the conclusion.

Other significant notes:

At some point, Godinez v. Moran was mentioned. This isinteresting because the Court found that if a person is found competent tostand trial, they are likewise competent to plead guilty or to waive anattorney. It also appears to say that a single standard of compentecy should applyto the whole of the criminal proceedings. This may be to wave off any futuredefense malingering each time the proceedings enter a new phase.

McKowan asked questions revolving around ayres desire totestify and his level of trust for his defense attorney. One of the two doctors(Gregory, I think) indicated that ayres had responded that he was not clearabout what he wanted to do, but that he wanted to do whatever was best for hiswife.

Jurors: a few appear very attentive and taking notes. Someappear to be goofing around (chuckling in the back row) and a few seem barelyable to stay awake.

My comments on the day:

1) Thank you to the family and friends present in the courtroom for being there, and for putting up with my testy grilling about what happened. If there are any corrections or additions, please post them. I'm tired and angry.

2) On Mcmullen’s diagnosis that ayres is depressed:

When ayres is so depressed that he frequently thinks about suicide (at least conceptually), has nightmares most nights about his family coming to harm, and wakes up every morning wishing he had died peacefully during the night, and when he does that retroactively for most of his adult life, or, when he engages in angry, risky behaviors that eventually kill him, THEN I will be satisfied that he is depressed enough.

Until then, he can go fuck himself.

According to Chanel 2 KTVU News reports, opening statements have occurred and:
McDougall is claiming that ayres is too ill to face retrial, and that he can't remember such things as what he had for dinner, and his son Robert's name.

The prosecution has conceded that the court appointed doctors say there there is some degradation of capacity, but that he is well enough to understand the charges against him, and fit to stand trial.

The article highlights the first defense witness: Solveig ayres, william ayres' wife. Solveig details several "forgetful" behaviors that she alleges ayres has experienced. She claims that ayres was "worried" because he could not remember the names of victims who testified against him in his molestation trial.

The MercuryNews article also says that McDougall could call as many as seven witnesses, and that the Prosecutor stated: "I will never disagree with the fact that he has some cognitive impairment [...] That is going to be obvious."

The San Mateo Daily Journal has an article tonight, with quite a bit of detail about the prosecutor's cross examination of Solveig, as well as references to ayres' adept sparring with the prosecutor during the first criminal trial.

The San Mateo Patch reports that on cross examination, the prosecutor asked Solvig if she was aware that if a jury found her husband incompetent, he could avoid a criminal trial and a jail sentence, and the couple could possibly live on together like before.

From observers in the courtroom today, we heard the following:

From one observer, we heard that the trial was underway at 9:15AM and that Solveig, (ayres' wife) has taken the stand, and that she said that he has difficulty remembering stuff, including his son's name and words from lists.

From another observer, we heard about some of the doctor's testimony:
A neurologist, Dr. Robert Telfer, that ayres went to see a few months after his first criminal molestation trial on the recommendation of his primary care physician, (Dr. Rizzo, or Ritzo) testified that he put ayres on Aricept for treatment of Alzheimer's (or the dementia related to it) but that ayres didn't take to it, so they took him off of it. He also reported that ayres said that his father had suffered Alzheimer's. The person reporting this said that the neurologist was very measured and considered on the stand.

In July 2010, ayres had an MRI that showed minimal shrinkage of the brain (apparently normal for ayres' age)

Also noted by our observer was that ayres got a 26 out of 30 on his first mini-mental state examination (MMSE or Folstein test) but the second time he took it he scored 29 out of 30. This is significant information, for a few reasons. According to published information, a score of 25 or better is considered to be "normal." Further, the observer, who has knowledge of the results of these tests said that the scores trend lower over time in an Alzheimer's patient.

Apparently in November 2010, another doctor in who ayres was referred to stated that ayres "probably" had Alzheimer's but "wasn't sure" and that it was hard to tell. (It wasn't clear if this doctor testified, or was included in the testimony of Dr. Telfer.)

It was stated that an MRI that ayres had did NOT show "white matter" that usually shows up in Alzheimer's patients.

The 14 person jury is very young, mostly men, and appeared to the observer to be bored and/or dis-interested in the testimony.

My Comments:
Many of the articles and descriptions from today discuss Solveig's testimony, about forgetting their son's name once, about not remembering what was for dinner last night, about sometimes forgetting words or names, and that ayres then makes lists of words he forgets or accidentally substitutes.

The prosecutor is reported to have pointed out that this kind of logical processing indicates that while ayres might forget words occasionally, the capacity to understand is still all there..

The first thought I had when I read about forgetting the occasional word, not remembering dinner, etc.. is: STRESS.

I have these kind of moments myself, and have had for quite some time. ESPECIALLY when there is high stress.

In fact, I have experienced these symptoms frequently over the last few years, every time ayres has a trial or hearing, or yet another trial is delayed. I forget the word I have just on the tip of my tongue, I say the wrong, but similar sounding word sometimes (less frequently) and ever since this morning, I've been wracking my brain trying to remember what I had for dinner last night (nope.. no drinking or other mind altering substances) I still can't remember. I do recall that we were going to order pizza, but then we didn't. No clue. I don't think I was experiencing dementia or Alzheimer's. I do know that I was stressed though.

If I'm stressed about the fact that the guy who molested me as a child is on trial, I'm betting that he's pretty good and worked up about facing jail time.

That ain't dementia or Alzheimer's. Cut the crap, and stop malingering. It's pathetic. Man-up, asshole.

Competency Trial Day Three - No News

No news for today:

Observers were not able to get into the courtroom today, at least as of about 3:30PM. Jurors were standing room only, and it appears that no-one was released between 1 and 3:30pm. This could potentially mean that voir dire will continue into tomorrow.

In any case, I don't know what the schedule is for tomorrow. I will try to call the court in the morning to see what the schedule looks like. Be aware that news may be thin from this blog AT LEAST through the end of this week. I will be watching the news to see if there are any reports, and post links, but I'm not holding my breath at this point.

Competency Trial Day Two

Almost a routine court business day:

Today was a jury selection day.

In the morning the courtroom was filled with jurors, and observers were not initially able to go in, as the courtroom was filled to capacity (about 70 prospective jurors). I’m not sure what exactly the process was, but mostly the business today was weeding out hardship excuses, probably through the juror questionnaire mentioned yesterday, and leaving those who were still qualified for more extensive questioning during voir dire on Wednesday afternoon. In the afternoon, at 2pm, the same process was slated to happen with another set of jurors. (I have confirmation that at 2pm another set of 70 jurors went into the courtroom.) This process could presumably continue through tomorrow morning.

As I mentioned yesterday, at 1PM PST on Wednesday, voir dire of the jurors will begin, after which, they’ll have their jury. It should be noted that seating will not be available for public (and public will be barred from the courtroom) until the point that enough of the jurors have been dismissed that seating becomes available.

Also as mentioned yesterday, ayres will be required to be present in the courtroom for voir dire at that point. On Monday, McDougall noted the 977 waiver allowing ayres to miss everything up until voir dire.

Here’s what wasn’t so routine:

william ayres and his vacuous wife Solveig showed up in the courtroom in the morning! ayres had his usual prop walker, but appeared to be clean, healthy and alert; beard neatly trimmed, and apparently has possibly even shed a few pounds.

As McDougall walked in, and walked past them sitting there, he whispered something to them. Something along the line of: You didn’t need to be here, or You shouldn’t be here, or You’re not supposed to be here. He also mentioned that they had the 977 waiver.

This would seem to me to be just another sign that ayres is as arrogant as ever, and that his attorney has little, if any ability to exert control over the notorious control freak. It is very likely that the last thing McDougall wanted was for ayres to be seen anywhere near the courthouse, let alone in the courtroom all day, before he was absolutely required by law to be there.

When McDougall presents his case that his client is so demented that he can’t even dress himself to get to the courthouse except when absolutely required by law, the jurors will all recollect him sitting there all day, even though his 977 waiver permitted him to be absent.

I have confirmation that ayres was present for the afternoon group of jurors too.

I don't know if: "My client is too fucking stupid and/or arrogant to follow instructions" counts as "dementia" or not, but I'm guessing probably not.

Competency Trial Day One

The 2pm continuance was extended to 3:30pm.

At 3:30pm trial logistics were discussed. Jury selection will begin tomorrow, Tuesday, June 7, 2011. Jury questions were compiled by the judge. Jurors expressing conflict of interest and jurors with hardships will be dealt with in separate locations.

At 1pm on Wednesday afternoon, voir dire will begin. ayres is required to be present in the courtroom at this point. ayres’ attorney Jonathan McDougall apparently made efforts to point out that ayres is incompetent at this point. (Fine... so wheel the drooling pervert in... let's see him mess his diapers.)

No electronic recording devices of any kind will be allowed in the courtroom. (As was the case for his criminal trial. Pen and paper seem to confuse the courts these days.)

Discussed during the proceedings was the case Medina vs. California.

This would seem to indicate that McDougall will be pushing for the court to take the position that the prosecution must show proof positive that the perverted molester is competent to assist in it's own defense, rather than relying on the defense to show that it is incompetent to assist in it's own defense. A subtle, but possibly powerful difference. The "traditional" view on an incompetence defense seems to be that the defense has the burden of the proof; after all, the defense is the one making the claim.

The implication of Medina vs California seems to be that the state has the responsibility not to put an incompetent person on trial. Possibly true. If so, then we need to try EVERY accused person for incompetence. And we should check to see if prison terms and financial hardship related to trial are going to exacerbate an prior, unrelated conditions of the offenders so that we don't burden them further. And if they become depressed or otherwise altered because of the punishment meted out to them, we should take steps to unburden them. And their families should be compensated for the inconvenience caused by a conviction.

Maybe we should just let them off without a trial at all.

Or maybe the offenders and their families should suck it up and take responsibility for the evil that has been done, pleading guilty to ALL charges that they are guilty of, and thereby relieving their victims of further hardship.

I wonder if anyone cares anymore about people getting away with doing grave harm to others. I think people like to hide behind the trappings of a "fair" system so that they don't have to face pain. If only we could make it so that no one was ever found guilty of the wrong they've done, we won't have to look into the eyes of the people they have hurt so grievously.

[Update:6/7/2011: The Mercury News posted a story last night, and this morning, San Mateo Daily Journal has finally published an article. You'll notice that they both mention that the defense has the burden of proof in this trial. They don't mention that Medina vs California was brought up and what the implications might be.]

ayres was slated for re-trial on April 12th, 2010, but McDougall managed to get the trial vacated on dubious claims that his client might not be competent to defend himself. Doctor’s reports were ordered, and after delays due in part to the difficulty in finding an impartial pair of doctors to evaluate ayres, both reports came back stating that ayres is in fact COMPETENT to defend himself.

The defense weasel then asked for a jury trial to attain even further delays.

The competency trial was scheduled for January 10, 2011, but on the morning of the trial, one of the two doctors mysteriously changed their report to state that ayres was not competent. The trial date was then vacated, and a third doctor was asked to provide an evaluation. After more delays, the third report came back stating that ayres is in fact COMPETENT to defend himself.

The judge then reset the jury trial to June 6th, 2011.

Thoughts on Monday’s Trial:

If all goes well, and McDougall doesn’t pull any further delay stunts on Monday, it’s likely that the first couple of days will be logistics and jury selection. At the time that this new date was scheduled, McDougall was already whining about the availability of some of his witnesses, so even if the trial DOES actually get underway this time, some of his “witnesses” will not be available until June 13th. Previously, the estimates were for a two week trial, and if that still holds, I suppose we can probably anticipate the trial running for most of the rest of June.

McDougall has a habit of waiting until trial day to “report” whatever nonsense is the current delay-du-jour, so it’s likely that he’s spent the last 5 months or so waiting for the start of trial to pull the trigger on his next delay. Usually there’s nothing the court appears to be able to do about it, so I’m not putting great odds on the actual start of the trial on Monday.

Assemblyman Rich Gordon Wants Input

I recently received this unsolicited email from Assemblyman Rich Gordon. He claims that he’s honored and privileged to be “representing” me in the State Legislature in Sacramento.

He claims that it is imperative that he hears from me! He encourages me to share suggestions by e-mail and wants me to show up at his upcoming town hall meetings. He claims that he “Looks forward to further communication."

That’s odd. He must not like Facebook as a method of communication, because awhile ago (while he was running for his Assemblyman position) I posed a pretty straightforward question to him on Facebook, and when he or his staff saw my question quite a number of days later, it was deleted, with no answer, and I was banned from posting on his profile. My post was not profane or even strongly accusatory.

In January of 2002, william hamilton ayres, (the San Mateo County child psychiatrist who now stands accused of molesting many young boys) was nominated by San Mateo County Supervisor Rich Gordon for a "Lifetime Achievement Award" and the resolution was passed by the San Mateo County Board of Supervisors in spite of the fact that several reports had already been filed (and dismissed without investigation) with various county agencies.

The text of the consent agenda from the meeting minutes says this:

Resolution (1945) honoring William H. Ayres, M.D. for his lifetime of achievement in the field of Psychiatry, service on the Children and Families First Commission, and for his tireless effort to improve the lives of children and adolescents (Supervisor Rich Gordon)

The question that I posed to Rich Gordon on his facebook page was as follows:

Supervisor Gordon:
I would be interested to know your current position on Dr. William H. Ayres, M.D. currently charged with many counts of molesting young boys who were under his “psychiatric care.”

It is clear that in 2002, you thought very highly of him when you nominated him for a lifetime achievement award: [Resolution (1945) honoring William H. Ayres, M.D. for his lifetime of achievement in the field of Psychiatry, service on the Children and Families First Commission, and for his tireless effort to improve the lives of children and adolescents (Supervisor Rich Gordon)]

This despite the fact that there are at least FOUR separate complaints on the record in San Mateo County PRIOR to your 2002 nomination of Ayres for his “tireless efforts.”

Has your position changed?

Perhaps Mr. Gordon has turned a new leaf, and is actually hearing the concerns of his constituents again. Fine. I’ll bite, and I’ll be less acerbic and more direct.

Here’s a suggestion for Mr. Gordon:

Please do everything in your power to influence, request, and/or cajole the San Mateo County Board of Supervisors to officially rescind the “Lifetime Achievement Award” for william ayres.

He has already settled one civil suit for a SUBSTANTIAL sum with one of his victims, whose only recourse was civil court, due to statute of limitations on criminal charges for molestation crimes. ayres is currently being sued by five other victims, one of whom has since passed away, and ayres is working successfully with his lawyers to continuously delay prosecution on his criminal charges.

It is clear that william ayres was doing exactly the opposite of working tirelessly to “improve the lives of children and adolescents” – He was manipulating friends and colleagues in his tragic efforts to ruin and gravely damage the psyche of many young men, myself included. He does not deserve the honor, and you have the ability to undo the continuous insult that the honor holds.

Second suggestion:

Please do some research on childhood sexual abuse, perhaps especially as it relates to young boys and the abuse’s effects on victims as they reach adulthood. It is quite typical for male victims of child sexual abuse to wait until they are well into adulthood before they report the crimes against them.

In California the statue of limitations on these kinds of crimes is insane. It is very rare (exceptional) that these victims come forward before the statute of limitations has expired. Most recent psychological studies/publications on the matter (Including one co-authored by the man who molested me, william ayres) discusses the extraordinary delay to reporting due to extreme feelings of guilt and other issues.

These are KNOWN and well documented behaviors, and it is criminal that California law does not take these facts into account when it sets statute limitations.

You can work to correct this gross oversight.

If you're in San Mateo County, and you're registered to vote, you probably just got a vote-by mail ballot for a County Board of Supervisors election. You probably also have received tons of fishwrapper ads and spam email from Gina Papan. (Wish I had *THAT* kind of money.)

Anyhow, Michael Stogner is one of the candidates. I like Stogner. He's been a CONSTANT supporter of the families and victims of william ayres, showing up for hearings and trials. He's posted updates on various forums that the victims watch for updates on the case. He's been an outspoken victim's advocate, and hasn't been afraid to criticize the D.A and the Sheriff for their shortcomings.

Miguel Frontera Lost His License For Molesting Boys. So Why Is He Still Claiming To Be A Board Certified M.D.?

UPDATE: 4/13/11: Beth Casteel, spokesperson for the American Psychiatric Association informed us today that Frontera has "been notified" that he is no longer a member of the APA.

Remember Miguel Frontera? He was the Baltimore child psychiatrist who had his medical license permanently revoked in March 2010 for molesting 12 young boys sent to him for therapy.

When revoking Frontera’s license, the Maryland Board of Physicians concluded that Frontera:

“was guilty of immoral and unprofessional conduct in the practice of medicine; failed to meet the standards of quality care; failed to keep adequate medical records; and violated the Board`s sexual misconduct regulations in regard to 12 minor patients.”

John Papavasiliou, the Deputy Director of the Maryland Board of Physicians had this to say about their decision:

"This is final, permanent and final. The board was emphatic in its decision and united, and it will not tolerate this sort of behavior from any practitioner."

It's been a year since Frontera was forced to give up his medical license. So what has he been up to?

Turns out he’s now working as a “medical director” for a company that he appears to have created just for himself. The company is called CAMELOT : Consortium for the Advancement of Medical and Evidence Based Learning and Organized Treatment Autism Spectrum Disorders Chapter .

In September 2010, Frontera announced - through a dizzying number of personal domains he created on the internet - that after “leaving” his staff position at Clinical Associates in early 2010, he was “appointed” to and “accepted the position" as the medical director for CAMELOT. Clearly he wants to give the impression that CAMELOT was wooing him!

On his CAMELOT home page, there’s a photo of two bare-chested handsome young men (who could still be in their teens) on a beach with two women in bikinis. Not only is this photo inappropriate given Frontera’s history, but what does it have to do with autistic kids?

And what is it that Frontera does over at CAMELOT? According to this bio, “Psychiatric practitioner, professor, and researcher Miguel Frontera, MD, serves as Medical Director for CAMELOT:ASDC (Consortium for the Advancement of Medical and Evidence-Based Learning and Organized Treatment: Autism Spectrum Disorders Chapter).

In this role, he diagnoses children with an array of autistic disorders, and he educates the public on these afflictions through the nonprofit's website. In addition, Miguel Frontera, MD, conducts in-depth research to identify causes and work toward new treatments for these individuals.

“Diagnosing children?” Does this mean he is still seeing children as his patients?

Another website, http://miguelfrontera.businesscard2.com/, says Dr. Miguel Frontera also uses the clinic to study the sleeping patterns of children with autism spectrum disorders (ASD) in order to correlate them with other ASD symptoms such as obsessive, self-soothing behavior and irritability.

What is one to make of Frontera’s CAMELOT “Mission” statement?

“We know that families affected by ASDS may sometimes find themselves desperately looking for solutions to problems they face. This may leave them vulnerable to being manipulated by sometimes well-meaning, sometimes-not individuals or outlets that offer treatments that sound promising bar are largely if not completely unproven."

It should be noted that William Ayres once upon a time wrote something quite similar for the Psychiatric News in 1997 when he was running for President of the American Psychiatric Association -- warning people against businessmen who“profit from the vulnerabilities of others” while extolling child psychiatrists like himself as "caring" about the needs of children.

And who is paying for Frontera’s job as medical director at CAMELOT?

According to the website:

“All research conducted at the Clinic will be funded through grants and private grants as well as through the private donations obtained directly and indirectly through this website.”

Only trouble is, there’s no contact any information for Frontera anywhere on the website. No email address, phone number or mailing address. A call to the Clinic’s “President” – a Baltimore geriatric psychiatrist named David Loreck about this organization - has not been returned.

A quick check of Frontera’s various bios elsewhere has turned up some falsehoods. For example, this bio http://cvshare.net/miguelfrontera states that Miguel Frontera, M.D. holds Board Certification in Child and Adolescent Psychiatry and General Psychiatry.

But Nicole Judge, spokesperson for the American Board of Medical Specialists says this is false - Frontera is NOT Board Certified.

And this website: http://miguelfronteramd.net/ says Frontera is a member of the American Academy of Child and Adolescent Psychiatry.

This is false as well. Annette Iverson from the American Academy of Child and Adolescent Psychiatry says that the Academy terminated Frontera’s membership as soon as the molestation allegations surfaced in 2009. She also stated that they are considering contacting the Maryland Board of Physicians about his continuing to claim membership.

San Mateo County: Come Have Sex With Our Children!

Ugh... Yet another installment...

According to Joshua Melvin at MercuryNews.com, Jeffery Gracia of Pacifica was convicted earlier this week for having oral sex with a 14 year old boy, and possessing child pornography.

According to the “Pacifica Patch” other charges included masturbation and anal sex, and included in evidence were hundreds of photos of Gracia posing with the young boys in Burma.

He was sentenced to a year -- ONE YEAR -- in JAIL -- minus time served -- (avoiding PRISON time) and five years of probation for his disgusting crimes, by San Mateo County Superior Court Judge Craig Parsons.

Apparently Judge Parsons was aroused by Gracia’s military service, volunteer firefighter duties, and having been smart enough to have not been caught diddling boys before or after the incidents in question.

The father and brother of the victim (both deemed even by the judge to be biased due to their fiduciary dependence on the perp) both testified on the PERPETRATOR’s behalf. Who needs enemies when you have family like that?

According to the “Pacifica Patch,” DA Steve Wagestaffe reports that in a lengthy response, the Judge indicated that he gave more weight to the Perp’s service than to the credible (in the judge’s words -- several times) victim’s testimony and the biased (in the judge’s words) family’s testimony. That, and the fact that he hadn't “committed” any NEW offences since 2001. (I think you mean BEEN CAUGHT COMMITTING, don’t you Judge Parsons?)

Judge Parsons is the same dude who pared Tarquin Craig Thomas’s 25 counts of lewd and lascivious behavior down to five charges. Fortunately (if you can call it that) there was enough heinously disgusting video and photographic evidence that the perp ended up with a 108 year prison term.

Gracia does have to register as a sex offender, a relative rarity for San Mateo County lately.

Meanwhile, Daniel Leon Stansbury got two years and eight months in PRISON for fraudulently receiving aid money when he claimed to be a victim of the PG&E explosion in San Bruno. Despicable behavior, and I think he deserves the time. But frankly the seven years and four months that Gracia COULD have been sentenced for the crimes HE was convicted of is far too light a sentence for his atrocities.

All because of the fabulous judges San Mateo County seems so fond of. Can we please remember these turd judge's names when elections roll around?

If DA Steve Wagstaffe had any objections to the "Judge's" light sentence, he apparently didn't voice them to either news agency.

The date for william ayres' "competency to assist in his own defense" trial has been set for:

But McDougall, ayres' weasel attorney claims that some of his witnesses will not be available until June 13th, so he's already built in a week of delay.

This is the THIRD attempt at a competency trial, with ayres' weasel lawyer getting a delay on the original October 4, 2010 date, as well as the more recent January 10, 2011 date, and further delays to the 3rd competency report requested by the judge. Let's hope this one sticks.

This will be the fourth attempt to try to squeeze a trial date for the THIRD attempt at a Competency to Stand Trial Trial out of Jonathan McDougall, william hamilton ayres' lawyer. Anyone taking odds?

At the hearing last month, it sounded like everyone was shooting for a May trial, the press is now aiming for June. Complications include McDougall's current trial schedule, as well as potential scheduling issues with the judge who was slated to hear the trial.

By the way, for those who didn't know: the "Mark Doe" in post below this one "Mark Doe: In Memorium" was the Mark Doe in one of the lawsuits against ayres. The money that McDougal is earning from ayres for his delays comes directly out of the souls of real humans like Mark and his family and friends.

william hamilton ayres was arrested on April 5th, 2007 on charges relating to his molestation of many young boys while he was allegedly providing psychiatric care, and was the one time president of the American Academy of Child and Adolescent Psychiatry.

Mark Doe: In Memoriam

I am sorry to report today that a victim of Dr. Ayres has died. His name was Mark; he was 44; and was the father of two children. He was a talented pianist and could play anything from ear.

Mark's life went into a downward spiral after Ayres was arrested in 2007. He had several DUI's. His new second marriage, which had started on a hopeful note, ended in divorce. He spent time in jail for drunk driving.

Although Mark never liked to talk about the abuse at the hand of Ayres, the pain and anguish in his voice was ever-present. Whenever I spoke to him, the pain and grief in his voice would haunt me for days.

This is the third Ayres victim I know of who has died. One named Alan died in a motorcycle crash in 2005, not long after writing a tragic email saying that no one was going to help the Ayres victims.

Mark himself told me three years ago that he had a death wish. I am just so angry that it has come true. If there are any Ayres victims reading this, please, please, don't end up like Mark and Alan.

So Long, Mel Levine, It's Been a Blast

ABC News in Raleigh-Durham NC today released Mel Levine’s suicide note.

Mel Levine was a “celebrity doctor;” a pediatrician who practiced at “Boston Children’s Hospital” from 1966 to 1985. william hamilton ayres practiced there from 1959 to 1963. Levine wrote books and lectured about learning disabilities, and went on Oprah. He was also accused by many men of molesting them when they were young boys. There are detailed accounts by his accusers in this New York Times article: Pediatrician in Abuse Case Killed Himself. I would urge you to go read the article if you’re sitting on the fence on this case.

His suicide note is a rather overwrought, dramatic presentation, meant mostly to further wound his victims, but in the end, he fails miserably.

The first page of his note is a “love” note to his wife apologizing to her (and their menagerie) , but noting that at least he’s left her with memories that she can “savor.” A touching handwritten note – well, at least the font that he used to type it was a handwriting font. He does appear to have signed it.

The second page is titled “Chapter 11 – The End”
On this page, he says that he was on his way to being a “comeback kid” but that his hopes were dashed when his lawyer told him that there was going to be another big lawsuit with 30 more cases. He talks about leaving quite a burden for “Bambi” his wife, and then says goodbye to all of the birds donkeys, dogs, cats, etc…

He says he’s going to shoot himself “Today” --- LOSING!
That was on the 11th of February. He broke that promise.

Then on the 14th, he claims to be “Alive if not well,” then he dramatically recounts for us how he recalled his “72 hour suicide rule” Dangit… *smacks forehead* “I can’t blow my brains out today… I have a RULE about that!”

The REAL reason for the delay, we find out, is that he wanted to find out the timing of the press conference in which the new cases are to be announced. He “decided it might be especially apt to end [his] life just before that grandstand event.”

Page 3:
His lawyer Ted didn’t know what the timing was, and so it appears that Ted bought the world 2 more days with Mel.

Levine talks about getting the feeling that even his lawyer didn’t believe him, and that there is some indication that Levine could end up in jail.

He talks about wanting a more discrete handling of his case, being assassinated by the press, press conferences are bizarre and abusive, and that it could lead to more “low on funds” people coming forward as victims.

He talks about Salem, Massachussetts, and society making little effort to protect the accused. He’s an innocent victim of “copy cat phenonmenon.” Also he had fun with Bambi over the weekend.

He hopes that his suicide will not “be read as an admission of guilt."

Page 4 (Last Page):
On the 17th, he talks about the schedule for the big press conference, and then pencils-in blowing his brains out for around 9:30am or so. He hadn’t slept well, worrying that the “shotgun that [he] bought a couple of years ago (JUST IN CASE) might not work properly”

He says: “dying this way is preferable to perishing in an ICU or shriveling away with metastatic cancer.” Where does the incarceration that he talked about on the 11th enter into his little vision of the future?

OK, Some thoughts:

I don’t have personal knowledge about the Levine case. It is my understanding that Levine had many accusers, and that they told their stories, and that they are people who don’t know each other, and who told very similar stories. My benefit of the doubt goes to the victims in this case, not to Levine.

My background is this: I’ve told the details of my story about william ayres to the police, before the first criminal trial of william ayres. I had told no one else any specific details, and never heard details from anyone else, and details in the press were very general and sometimes incorrect. I spoke about details that they seemed to believe. When the trial happened I heard about testimony from other victims. Their details were sickeningly the same as my details. Some of them, things that I hadn’t mentioned to the police, but that I unfortunately also knew from experience. I KNOW that ayres did what he is accused of, and I KNOW that he did it to many others. THIS parallel is the basis for my assumption that Levine’s victims are telling the truth.

Maybe YOU don’t like that I assume Levine’s guilt rather than his innocence, but:

1) You are wrong that you are required to “assume innocence.”
2) I don’t care that you don’t agree with my opinion.
3) You are stupid if you always assume innocence.
When your stupid assumption bites you in the ass, I’ll promise to be a sympathetic ear, even though YOU weren't. Why aren’t YOU here for US, right now? (this is a moral question -- you're supposed to pause and search your soul now -- note that I'm giving you the benefit of the doubt; assuming that you HAVE a soul.)

In Levine’s note, he talks about the media assassinating him; he mentions Salem. These are the VERY things that william ayres’ supporters bleat about whenever they have the opportunity. It is the ONLY defense they have – that we’re all SUPPOSED to believe that THEY are the innocent party. Even ayres’ attorney bleated about it at trial: He mentioned the McMartin case, the Salem witch trials, etc, etc…

Saaaa-leeeem, Saaaaa-leeeeem, Maaaaa Saaaaa Chuuuuuu Seeeeeets. Miiiiiiick Maaaaaaaarrr Tiiiiiiin. Stupid, stupid sheep.

These are ALWAYS the fall-back arguments -- make people feel guilty about actually believing that the victims are telling the truth.

On Levine’s idea that “it might be especially apt to end [his] life just before that grandstand event”:

These guys are CONTROL freaks, and they have no soul. Bullies, rapists, child molesters: they are psychic vampires – they have no soul of their own, and they crush the souls of innocent people to bring people down to their level so that they can feel human. william hamilton ayres, upon settling for a moderately high six figure settlement to one of his victims tried to further insert himself into his victim’s life: he wanted control of the money! He wanted to be able to force his victim to use the money in the ways that he chose. You can read all about it in the San Francisco Chronicle.

Even in his suicide to escape his fear that he’d be imprisoned, Levine hoped to control his victims by convincing them that he was the injured party: he exclaims that his suicide was not to “be read as an admission of guilt.”

Victims, take heart!

COMPETENT! (Duh)

william hamilton ayres, accused of molesting many young boys while he was alleged to be providing psychiatric care, was found to be COMPETENT to assist in his own defense, as was predicted two weeks ago.

The third doctor’s “tie-breaker” report was apparently received just this morning before court. The tie-breaker was needed because although the original two doctors found ayres to be competent, one of them (Dr. Jatinder Singh) mysteriously waffled the day the competency trial was expected to start, and changed her report. (I know... the logic is convoluted. Justice does not apparently rely upon actual fact and logical argument. If you're new to the case, and trying to figure out what state the case is currently in, the brief background is here.)

The defense had seen the current report this morning, just before the hearing. The prosecutor had not yet received a copy.

Next Friday at 9am, there will be a hearing in front of Judge Grandsaert to set this year’s second attempt at a competency trial date. (It will be the third attempt at a competency trial.) It sounds like there may be scheduling conflicts with Judge Grandsaert's schedule, and yet another judge may be involved....

The San Mateo Daily Journal should be putting up something soon... they came here poking around with a "william ayres child psychiatrist blogspot" google query. They usually have a tidbit or two from the prosecutor, and a "did not respond" from the defense. I'll post a link if they get around to a story.

From snippets of conversation overheard in the courtroom, it appears that the report was not quite ready, and there may have been additional scheduling conflicts due to McDougall's Youshock trail.

The San Mateo Daily Journal is now reporting on yesterday's hearing:

They report (as we did) that the third report is due back in court on March 4, 2011, and that they needed two more weeks to complete the report.

They are also reporting that regardless of the outcome, the william ayres' defense attorney will very likely request a jury trial. The reporter says that McKowan has indicated that May is the target month for the competency trial, due to ayres' attorney's other court obligations.

They also are reporting that if he's found incompetent, he'll be sent to a state mental hospital, but this does not seem to be set in stone, as we have on other occasions heard that that would be one possible outcome, but that it could also be something like "outpatient treatment." Apparently this decision will be made based on a number of critera, such as severity of whatever the alleged medical condition is, and some determination of whatever his risk to others may be. Perhaps these critera are already "known," and confinement to a mental hospital is the only option on the table.

It is my belief that the report will show that ayres is indeed competent. But for that we'll have to wait a couple more weeks.

Accused Pedophile Pediatrician Mel Levine Found Dead in North Carolina Yesterday.

The Boston Globe is reporting that formerly renowned pediatrician and best selling author Mel Levine was found dead in North Carolina yesterday. This comes two days after a press conference in Boston by lawyer Carmen Durso to announce a class action suit by more than 40 men who said they had been molested by Levine at Boston Children's Hospital from 1966- 1985. Please note that Dr. William Ayres also practiced at Children's Hospital from 1959-1963.

Dr. Melvin D. Levine, a former Children’s Hospital Boston doctor and best-selling author, was found dead yesterday, his attorney said, a day after he was sued over accusations that he sexually abused thousands of pediatric patients.

News of Levine’s death came a day after a class action lawsuit was filed in Suffolk Superior Court contending that the doctor sexually abused as many as 5,000 patients during his 19-year career at Children’s Hospital. The suit named the hospital and Levine and asserted that he committed medical malpractice and that the hospital was negligent in failing to properly supervise him.

The suit cited 40 former patients, all young boys at the time, who said that Levine performed unnecessary genital examinations.

Boston lawyer Carmen L. Durso said his suit sought to represent all children examined by Levine when he worked at Children’s Hospital, from 1966 through 1985.

“On a typical visit, he would tell the parents that they could not come into the examining room, because that would interfere with his ability to perform a proper examination,’’ Durso said at a press conference Thursday in his Boston office. “He would require the boys to strip naked, not just for when he did the exam, but for the whole time of the exam, regardless of the reason for the treatment.’’ Durso said Levine performed prolonged genital exams.

After learning about Levine’s death yesterday, Durso said his clients would evaluate whether to pursue their claims against his estate.

What a coward Levine was for refusing to face the reality of what he had done. Here's hoping all of his victims pursue their claims against Levine's vast estate.

Boston Children's Hospital - where Levine worked from 1966-1985 and is also being sued by Levine's victims- appears to have been quite the hotbed for pedophile doctors:

William Ayres worked at Boston Children's Hospital from 1959-1963.

Donald Lee Rife, whose license was revoked in three states for molesting adolescent boys, worked at Children's from 1964-1966.

The Boston Globe is reporting today that Levine died by a 12-gauge shotgun blast to his forehead:
"Pediatrician's Suicide Soothes No Wounds"

More importantly, a number of Levine's victims break their anonymity and using their full names, talk about the abuse.

One man, who is now a fireman, recounts that as a ten year old, his parents allowed Levine to take him on a trip to Washington, DC. At their hotel , Levine made the boy get into bed with him and then fondled him repeatedly.

Here's an excerpt:

Among the alleged victims who joined Durso’s latest lawsuit, Neil Liston still harbors deep anger toward Levine. The 38-year-old personal trainer from Nahant said Levine fondled and performed oral sex on him during an appointment at Children’s in 1979 when he was 7.

“When I saw my mom after it happened, I was so freaked out that I wet my pants,’’ Liston said. “I remember looking at his head and not understanding what was happening. I remember holding my breath.’’

He said he told his family what happened, but his grandfather decided to keep quiet because he thought nobody would believe them and that it would cause Liston more problems if they made a big deal about it.

He blames the experience on a long list of personal problems and said he requires therapy and struggles with depression.

“When I learned that he died, the truth is that I felt robbed,’’ he said. “I just wanted to look at him and see what his reaction was when he had to look us in the eye . . . I didn’t want an apology; I would have liked to punch him right in the head. Maybe I wanted some sort of admission of guilt.’’

Competency Hearing Delayed Again

Friday, February 18, 2011 :

The hearing to review the report from the third doctor evaluating william hamilton ayres' competence to assist in his own defense at trial has been held over.

The hearing is delayed until Friday, March 4th at 8:45am.

Snippets of conversation overheard seem to indicate that it's possible that the doctor needs more time to complete the report, and that there were scheduling conflicts with McDougall's other ongoing trial with defendant Robert Youshock.

Let's see if the press is persistant on this one... There should be some nuggets of information to find....

william hamilton ayres, alleged psychiatrist and accused molester of many young boys under the guise providing psychiatric care, is in the middle of a long delay game: his attorney requested that ayres be evaluated for competency to defend himself. The two doctors assigned to do the evaluation reported that ayres is competent.

ayres' attorney then requested a trial to decide his client's competence. In the eleventh hour, just before the competency trial was to start, one of the two original evaluating doctors, Dr. Jatinder Singh, changed her assessment. (Surprised that it was last second?) and so judge John Grandsaert, who will be presiding over the competency trial requested a third assessment. The competency trial is therefore on hold pending the delivery of the third doctor's report on February 18th, 2011. Last time, they had trouble finding two non-biased doctors to issue the reports, and then the reports were late, so I expect more of the same.

This delay tactic seems to be the only play in ayres' attorney's playbook, as he's using the same pathetic tactic with his other "bigtime" client, Robert Youshock. In fact, a doctor's report for Youshock is also due to be revealed on Friday the 18th, as well.

At this point, I'm prepping for one of the following two possible outcomes tomorrow:

1. The report is late.

2. The report says ayres is not competent, and rather than going ahead with the trial, the judge decides to not have the trial and declares ayres incompetent, and remands him to "outpatient treatment", allowing him to continue living at home where his twisted wife can continue to pretend to ignore his attraction to 11 year old boys.

This solution would work well for San Mateo County, which can't afford the lawsuits that would stem from a finding of guilt, after all of the opportunities that the county had to stop the twisted pedophile, and after remanding young boys to him for "evaluation" through the juvenile court system, and for which he was the low-bid contractor.

ayres standing trial would be just one more spotlight on San Mateo County's troubles, given all of the digging that the FBI and others are doing into Steve Wagstaffe and his staff:

Civil Cases: Uninformed Update

Brief Info on the FIVE civil suits:

There are currently FIVE known lawsuits against william hamilton ayres relating to his molestation of young boys under the guise of providing psychiatric care.

The San Mateo County court has an online case status system providing information about the civil cases. As of the last check on February 15th, 2011, Three of the five civil cases show ambiguous status: the latest hearings/actions are listed as completed, but the overall case status is not documented, and there are no hearings/actions pending as of right now.

TWO of the five cases now show the following status, as of February 8, 2011:

ORDER GRANTING STAY OF CASE PENDING CRIMINAL TRIAL OF JOHN DOE 1, SIGNED BY JUDGE FREEMAN ON 02/04/11 FILED.

This means that Judge Freeman - the judge running the show in william hamilton ayres' pending (possibly) criminal trial for charges relating to molestation - has put a stop to any further proceedings on at least these two civil cases. This could be indefinite, or it could just be a holding place, so that the court doesn't have to waste time and money with continual hearings just to keep saying "lets wait until the criminal trial finishes" every six months. It is possible that if the criminal case ever takes place, then the stay on the civil cases will be lifted.

My GUESS is that at least these cases are structured around a finding of guilt in the criminal case, and that BOTH sides want to wait until the outcome. I could be very wrong... Maybe someone will correct me.

READ 1/11/2011 UPDATE BELOW

Joshua Melvin at the MercuryNews.com is now reporting that one of the two doctors who said that ayres was competent to stand trial has now changed her mind based on a follow up exam in December.

ayres' attorney thinks that it's enough to stop the molestation trial, McKowan does not.

Melvin is also reporting that Jury selection is put off until FEBRUARY 18th, which is when the third report is due back. (This is in conflict with plans that were made in court this morning, so we'll have more information on that tomorrow, hopefully...)

An astute reader has pointed out that the newspapers are reporting FEBRUARY 18th... I missed reading the month in both news reports.

Brief Competency Trial Update

Here's the update in brief:

Today's discussion centered around trail mechanics: there was struggle with potential delays to the trial related to some of the doctor's reports not being available, and possible schedule conflicts with the judge selected to hear the competency trial. These delays appear to have been mitigated over the course of the morning.

The judge will be John Grandsaert, and jury selection will be tomorrow and Wednesday, in all likelyhood. Jury selection process is open to the public, and will take place in Judge Grandsaert's courtroom.

It's not clear what will be happening beyond that, other than that the trial may not actually start with witnesses until the 18th, with ayres' defense witnesses first, and the prosecutor's to follow, probably starting on Thursday of next week. Potentially the jury will then deliberate the following week, if things go roughly along this plan.

The competency trial for ayres begins TODAY at 9am.

The subhuman, william hamilton ayres will stand trial starting today. The subhuman’s defense attorney has asked for a trial to determine whether or not william ayres is competent to assist in his own defense in his retrial for many counts of molesting young boys under his “care” as an alleged child psychiatrist. The molester ayres was the one time president of the American Academy of Child and Adolescent Psychiatry, an organization which apparently takes little or no interest in vetting its members, as complaints about ayres started early, and were promptly ignored by officials.

The subhuman’s defense attorney is pulling his usual delay stunts, hoping to hold off the actual molestation trial for as long as possible, either until the molester dies, or his victims all succumb to the pain and frustration of being continually in limbo and either drop out of the trial, due to mental trauma, severe disruption of their ability to function productively, or God forbid, succumb to even worse fates.

Lord knows, victims of childhood sexual abuse need some kind of mental health repair, but I hope you’ll understand why at least some of ayres’ many victims would rather help bury shrinks than actually have a conversation with one.

Meanwhile, william hamilton ayres has already been found competent to stand trial by the two court appointed head shrinkers assigned to evaluate him.

The question of the week is:

After Jonathan McDougall, the alleged psychiatrist’s defense attorney, wrings his hands and grandstands with motions for a while, will he actually waste the taxpayer’s money on a competency trial, or will he just turn tits-up, like a prissy little twit -- as he did with the Robert Youshock competency delay stunt?

I watched all last week for heads up news of the trial, and there was nary a word until this morning, when the San Mateo Daily Journal did finally publish this. I guess they decided they needed to write something after scraping this blog several times over the weekend and found not a peep.)

Meh.

Last Friday I mentioned Bill Zeller. He was a apparently a talented programmer, and also an extraordinary writer, at least he was in his suicide note. I didn’t post the link to his suicide note, because I’m very afraid that one of us victims of ayres will read it and take it as a nod to go ahead… I really hesitated to even mention the note. Having said that, Bill's note makes it clear that he was a force to be reckoned with, and it's unfortunate that he felt such pressure to leave us.

Here was my take on the note:

I read it, and was very devastated, but somehow in a positive way. The fears and actions, reasons that he behaved the way he did are mostly very familiar to me. His abuse was extreme. If you read about childhood sexual abuse, you will see that these are all well documented and a common range of experiences from all of us. But reading it in a psych treaties, and hearing it from someone else who suffered from it are a world apart; feeling that no one really “gets” our mindset is very difficult, so it IS helpful to read from someone who CLEARLY did. His discussion about the "wait" and not wanting to wake up the next morning, and of being something of a robot, the omnipresence, social discomfort, and being repelled by physical contact... all of them hit home. I've wanted to write about them in the past, but they are too painful. Bill succeeded here, in flying colors.

There are some things that Bill talks about that don’t resonate with me particularly the last half of the letter when he discusses his family and religion, he doesn’t say where his abuse came from, but it seems that it may have been from some church contact. In any case, those are the details unique to his experience, and I won't detract from them.

He also doesn’t talk about the impacts that relate to marriage and children. It doesn’t appear that he was married or had children. I firmly believe that we begin to deal with the reality of our childhood sexual abuse in a big way when events happen in our lives that force us to face the terror and the warped world perspective we developed as children. Marriage and having a child are two of these.

Imagine beginning to fear that you’re going to be a child molester too, because of what you’ve experienced as a child, and were silent and guilty about. Imagine not wanting to have children because you’re afraid of what might become of you, and yet, you have no way to express the fear to your wife, because you’ve been silent, when you should have told her before you were even dating, so that she’d know the hell you’d be putting her through.

After you make it the first few years of having a child and realize that you’re not going to turn into a molester, then you start to realize that you’ve got a child to protect. And that’s when things REALLY start to fall apart.

At any rate, Bill’s note struck me because he didn’t seek help, and really, neither will I. Probably for different reasons - I don’t know where his abuse came from, but as time goes on, I have less and less faith in psychiatry. It’s just too much power for a person to have, and too easy to abuse.

San Mateo County: Come Have Sex With Our Children!

Michael Christopher Bellemur plead "No Contest" to charges relating to having sex on multiple occasions with a 12 year old child (a girl).

I've talked about this case a few times, but sentencing was yesterday. There are so many things wrong with this case I hardly know where to start.

Let's start with the place I read about this: The San Mateo Daily Journal

The writer of the article says things like: "The Burlingame man who had consensual sex multiple times with a 12-year-old girl..." and "On their first date..." and "the pair proceeded to engage in sexual activity" What the fuck kind of twisted writing is this? a 12 year old does not have consensual sex with anyone, and these were NOT dates. How the hell many times do I have to say it?

Words fail me. I've re-written the next sentence many times, and you'll just have to settle for poorly worded thoughts: Maybe the reporter was trying to maintain a "neutral" or non-biased position in this story, or something similarly ridiculous. Maybe the reporter has never been, or doesn't know anyone who has been sexually battered, bothered, inappropriately leered at, or anything like it... it's the only way I can imagine a reporter choosing these truly inappropriate words to describe the case. It's utterly offensive.

It's sad to think about the mental/emotional struggle that the girl will face as she grows older, and that she'll have this reporter's words to look back on -- words that are essentially ascribing culpability to the poor girl for something really damaging that was done to her. This reporter is simply heaping hurt onto painful hurt. Great job.

Let's talk about the charges and the DA:
On multiple occasions the fucked-up creep had sex with a 12 year old girl. He could have been charged with multiple counts of "lewd and lascivious activity with a child under 14" with special allegations for substantial sexual conduct, resulting in decades of prison time (appropriate, given the facts.) The prosecutors wanted TWO YEARS IN PRISON for the no-contest to "felony unlawful sexual intercourse" plea.

The judge:
The "honorable" Judge Susan Etezadi opted to give him six months with credit for 56 days of time served. He's out and about on his $125K bond though, because the "honorable" judge gave him until the middle of January to keep molesting kids - er - report to the jail. Oh, and he doesn't have to register as a sex offender either. That way, he can keep committing the same offenses against children, and no one will be any the wiser!

Don't worry though, according to the article, Steve Wagstaffe respects Etezadi's decision, although he maintains that he wanted two years (again - What the fuck?).

SO, if you want to fuck kids, and get a minimum of time if you're caught, and aren't friends with the "right" folks, come to San Mateo County! We'll get you back on the street looking for victims in no time!

ayres' Competency Trial is Delayed

The ayres' competency trial has been delayed until January 10th.

The judge indicated that this would be the "LAST" time delay would be allowed. Just like all of the other last times.

What a crock of shit.
Fuck You San Mateo County.

As commenters have noted: no word in the press about the delay being granted. People from The San Mateo Daily Journal DID pop in here yesterday afternoon to read about the results though.

Apparently, this time the beast's asshat attorney, Jonathan McDougall, really, really, REALLY believes that ayres has dementia or Alzheimer's or something, and he needs to have really REAL tests done. Good thing McDougall waited until just before the competency trial to realize this, otherwise they might have had the really REAL testing done by the time of the already scheduled trial and could have continued without delay. At least the judge has promised that this will be the LAST delay. For Reals.

Just checked with the court clerk. There is indeed a hearing tomorrow, Friday, September 24, 2010 on Ayres' lawyer's motion to continue the mental competency trial date.

The hearing is scheduled for 8:45 am in Courtroom 2A in the Redwood City court house.
