Bad Justice - Marta Diaz

Bad Justice:

The San Mateo County Court has re-appointed Judge Marta S. Diaz (pdf) to the Juvenile Court after having removed her as a justice of that court several years ago.

Some highlights from Judge Diaz’s bio: 

Diaz appointed Stuart Forrest to the head of the Probation Department after Forrest's long history of working with youth in San Mateo’s juvenile justice system. Recently, Stuart was found guilty and convicted of being in possession of hundreds of pornographic and sadistic images of young boys.  Here’s what Diaz had to say in a county news release about Stuart at the time she appointed him to head of the probation department: "I've known Stu for a very long time. His modesty and leadership skills are only exceeded by his ability and integrity."

Diaz also was a significant figure in the career of convicted child molester william hamilton ayres:

Diaz is observed to have been personal friends of the ayres family, and was responsible for referring many young boys to ayres for “evaluation” during her career in the DA’s office and as a judge. (Note that there were OTHER judges who also referred cases to ayres; many of whom have expressed regret for having done that).  In spite of the fact that at least four reports claiming sexual abuse had been filed (pdf) with the county between 1987 and 2002, and, in spite of the fact that Diaz was aware of the investigation by police who were building their criminal case against ayres, she continued to refer boys to ayres for “evaluation” for another fifteen months. Convicted child molester william ayres himself testified that this was so in depositions given in 2004.

Further, Diaz is reported to have tried to get the police to stop investigating ayres, claiming that she and ayres were very good friends. More than two decades ago, it is said that a defense attorney for a young boy told Diaz (then a prosecutor) that his client had been molested by ayres. Diaz denied that that could be happening, that she knew ayres well.

In March 2009, Diaz was asked about these claims by reporter John Roemer of the Daily Journal, and she responded that certain private citizens have a little “jihad” against her – She said: “I don’t care. I know it’s all bullshit. All will come out.”  (Yup, you stupid bitch – the truth did "all come out", and your sick-fuck friend is rotting in jail.)

After making the above statement to the press -- and shortly after the conclusion of review and action on a complaint filed with the Commission on Judicial Performance -- Diaz was removed from the Juvenile Court and reassigned. 

I guess the San Mateo County Court feels that now that people are no longer focused on her extraordinarily poor judgment, they can put Diaz back to work making devastating decisions for the county’s youth.

Lopez, Stogner, De Paula and more!

Election Day is nearing.

The Mercury News(pdf) has refused to endorse incumbent Sheriff Munks, and instead has recommended Write-In Candidate Juan Lopez.

Even though Lopez is new to the political scene, according to the Merc, "He has worked patrol, jails, gang investigations, sex crimes unit, community policing and inmate transfers" in San Mateo County since 1987. Additionally, Lopez launched the San Mateo County Sheriff's office community policing unit. I feel that it is significant to note that Lopez is championing bringing back the County's sex crimes unit -- Something that the current sheriff discontinued due to "budgetary concerns" a few years after being busted by the FBI in the "Operation Dollhouse" raid on an illegal brothel said to be employing underage prostitutes. (For which no apparent investigation of Munks happened, and for which Sheriff Munks has never clarified for the public, beyond saying that he wasn't going to talk about it...)

The Mercury News reports that Munks refused to come in for an endorsement interview, "noting in his response that he is "running alone on the ballot.""

Michael Stogner and Mark De Paula have both spent some time during their campaigns pointing out the importance of writing in Juan Lopez. If you are in Stogner's (District 3) or De Paula's (District 2) voting district, you should thank them for calling attention to the Munks issue by voting for them as your County Supervisor!

NOTE: To vote for Juan, (and you should) you need to select the "Write-In Candidate" option, and fill in the name "Juan Lopez."

On June 14, 2014, USA Swimming is slated to induct executive director Chuck Wielgus to the "International Swimming Hall of Fame"

Many victims of childhood sexual abuse at the hands of swimming coaches within the organization have stated that Wielgus has in many of the cases helped to quash knowledge of these abuses from spreading, acting to protect the abusers; much as bishops and cardinals in the Catholic church have downplayed or covered up abuses in order to protect the organization.

These victims have started a petition that is worthy of your signature, asking that this induction into the "International Swimming Hall of Fame" not occur.

My Election Recommendations

The upcoming Election on June 3, 2014 gives us three opportunities to positively change politics in San Mateo County.

Generally I hesitate to make recommendations on how, and for whom people should vote, as I tend to piss people off with my angry, biased, and too-frank comments.

But, as all of the local papers have made their ill-advised, County-Mouth-Organ recommendations, I figured I’d make some recommendations of my own, and hope that you’ll vote for these good folks in spite of how miserably intolerable I am….

Vote for Mark De Paula for County Supervisor in District 2, Vote for Michael Stogner for County Supervisor in District 3, and WRITE-IN Juan Lopez (deputy Sheriff) for the office of Sheriff of San Mateo County.

Sheriff  (For voters in ALL San Mateo County Districts):

The current Sheriff (Sheriff Greg Munks) is running uncontested on the ballot. (He’s the only candidate listed.) Munks was busted along with his Undersheriff Carlos Bolanos in Las Vegas in 2007 in an FBI sting at an illegally operated brothel that was using underaged, possibly trafficked prostitutes.

Munks and Bolanos were released, and have never spoken publicly about their status, other than Munks’ comment: “I believed I was going to a legitimate business -- it was not. (I won't) be answering any more questions or talking about this anymore in the future..” (Even though the brothel was at a private residence, not a massage parlor, and prostitution (adult) is not legal in that part of Nevada. Authorities describe the location (pdf) this way: "run-down apartments and homes with mattresses on the floors and the stench of cigarettes, urine and feces in the air") A credible source has indicated that the ensnarement and release of Munks and Bolanos  poisoned the sting operation, resulting in the release of other men who were there to take advantage of sex slaves -- some of whom were underage. Two of the several people running the brothels were convicted and received suspended sentences. Bolanos said that he didn't go in, he was just waiting in the limo; as there was no apparent investigation, I suppose we can either assume Bolanos is either lying or telling the truth.

Sometime subsequent to this (2010), the Sheriff disbanded the County Sex Crimes Division citing budgetary concerns, in spite of the fact that the San Francisco Peninsula is one of the most significant areas of rampant trafficking activities in the entire country.

An article in the Palo Alto Daily Post has documented a recent incident that occurred in a public venue in which Mark De Paula (running for District 2 County Supervisor) asked Sheriff Munks what his status was with regard to the “Operation Dollhouse” sting. Munks’ reply was to suggest to an officer with him that De Paula “probably doesn't belong here.” The other officer escorted De Paula out so that they could “discuss” De Paula's undesirable presence.

Munks is clearly not the guy who should be in charge of investigating trafficking crimes or sex crimes against children.

Write In: Juan Lopez (Website, Video Statement, Mercury News (pdf)): Fortunately, there is a formal write-in campaign for Juan Lopez. Look around – you’ll see his flyers posted in the local Starbuck’s etc…

His name won’t appear on the ballot, but HE IS a REAL and viable candidate. Just write his name in on the write-in line rather than voting for Munks.

Juan Lopez is, and has been, a hard working Sheriff’s Deputy in San Mateo County for many years. Here are just a few points from his platform. Lopez has said that he wants to run a clean campaign, and indeed, does not appear to have spoken ill directly of Sheriff Munks, but he has made clear his intention to run things a bit differently:

Analysis of Crime Trends
Currently there is no crime analyst or sustained analysis of crime trends in the County. I will change this by creating a full time position to direct the resources of the county efficiently and inform you of crime trends which need to be address.

Protect Against Sex Crime
Currently there is no sex crime unit at the Sheriff's Office. It was disbanded several years ago. This decision was short-sighted and flies in the face of reality on the ground, with approximately 300 such cases received a year by this office. Not to mention the need to pro-actively monitor sex registrants in our jurisdiction. I will change this, restore and fully staff the unit - to protect our children.

Protect Against Domestic Violence
Currently there is no dedicated domestic violence unit. I will change this and fully resource what county leaders have already identified as an important issue.


District 2 County Supervisor:

The incumbent is Carole Groom. Carole was very recently caught in a significant lie with regard to the protection of Sam Trans accounting whistleblower Ling La, who was terminated after she reported hundreds of thousands of dollars in accounting discrepancies. (Mercury News (pdf))

This kind of behavior is reprehensible, and Carole should not be re-elected.

Vote Mark De Paula (Website): Fortunately, De Paula (The very same guy who was trying to get to the bottom of Sheriff Munks’ bust detailed above) is running against Carole Groom. Mark IS on the ballot, so just tick the box next to his name if you're a voter in District 3.

Mark has been a longtime resident of the area – he grew up here. He’s promising to serve only one term, and is for transparency, independent oversight and auditing, and balanced budget, among other things.

District 3 County Supervisor:

Vote Michael Stogner (Website, YouTube) who is running against incumbent Don Horsely.

Stogner is a long time victim’s advocate and taxpayer advocate, and champion of removing corruption from local government. He was one of the first people that I can recall to really call attention to Munks’ misbehavior in Las Vegas, and question his current status, as well as question why the County's District Attorney  in communication with Munks about the issue would call it a non-issue, and that it would all blow over.

Stogner’s platform includes focus on elimination of corruption in San Mateo County government, as well as many critical budget reform oriented goals: balanced budget, pension reform, etc... as well as  elimination of prosecutorial misconduct, single-point database for whistleblowers, and many other good and necessary reforms.

San Mateo County's District Attorney has generally run against no opponent, for many, many years.
San Mateo County needs a fresh perspective for its District Attorney Office. The deadline for filing for candidacy for the Office of District Attorney, to run against the current DA Steve Wagstaffe is drawing near.

San Mateo County needs a DA who will not be lax in prosecuting sexual crimes against children, as the current DA's record  proves. We need a DA who will prosecute child molesters to the fullest extent of the law, rather than allowing sex offenders to avoid registration, and serve overly short jail sentences.

We need someone to run who has compassion for the LAW ABIDING citizens of the County of San Mateo, and who won't bow to the wishes of the powerful and wealthy criminals in our midst.

We need to have a candidate who will truly "seek justice and accountability for all who violate the law in our county." and  "also seek to provide assistance for those victimized by criminals."


We need a person of compassion, action, and understanding.

Some (Temporarily) Good News

Some refreshing news --
william h. ayres, convicted child molester (inmate number AR2048) is reportedly currently being held at the California Health Care Facility at Stockton. In part, he may have been incarcerated at that location due to his own son Robert Ayres' pleading during the sentencing phase of the child molester's criminal trial. Robert plead with the judge: “Be a hero” and send ayres to someplace close, with a medial facility capable of treating his dementia, if not simply releasing him for "medical" treatment.

The Stockton facility was supposed to be a "state of the art" cushy medical lockup facility, intended to help with "prison overloading" and to help inmates with complicated medical issues. Based on what the Stockton Record (pdf) has to say, the facility is a miserable, torturous, biomedical wasteland. In fact The Record says that admissions to the facility "have been temporarily suspended by a court-appointed medical receiver because of unsanitary and inadequate conditions."

The article talks about a complete breakdown in supply chain: medical supplies are not replenished in a timely manner (catheters, diapers, gloves, towels), prisoners have little to no state supplied clothing, and no jackets despite cold weather. There was a "soap and towel shortage that led to patient-inmates being unable to take showers. Often, they were using dirty socks to dry themselves."

"Patient-inmates were found to have diaper and catheter leaks, skin tears and other problems as a result of poor care." There are serious staffing issues, and calls for assistance by inmates are going unanswered for long periods of time; inmates say that a man who had been bleeding for days died after calling for medical help with no response for more than 30 minutes. Others tell of inmates stewing in their own feces all night long. (I find myself wishing that ayres actually DID have significant medical issues!)

The lack of soap and showers along with generally unsanitary conditions in cells has caused a highly contagious outbreak of scabies: mites that burrow into the skin causing painfully uncomfortable itching and rash especially in tender areas like between the fingers, in the armpits, and joints, and around the genitals.

Probably ayres' San Mateo County pals will get him moved someplace less miserable (if they haven't already), but in the meantime:

Stockton Diocese Fr. Michael Kelly Criminally Indicted

According to Lodinews.com (pdf) Fr. Michael Kelly of the Stockton Diocese has been criminally indicted by an impartial Grand Jury of his peers, and authorities are now seeking to extradite the "Priest" who has already been found liable in civil court of the molestation of young boys. If you recall when we reported on this awhile ago, Kelly fled to Ireland just after he had been found liable for the molestation of a young boy, but before the trial was completed -- before the award phase ($3.75M awarded) Additional lawsuits followed. The asshat Catholic Church has not defrocked the pervert, but they don't want him to do communion or wear his collar, and you know... molestation is totally frowned upon by the Church unless it can be totally covered up (or something....)

More News:

According to Lodinews.com (pdf), the Stockton Diocese has also today announced that they will be declaring bankruptcy. This would be GREAT news if the Diocese were selling off all properties and shutting down all of the churches and schools and other "good works" they have underway in order to make payments to the victims.

Unfortunately, the real reason is of course so that they can protect the assets that are not already protected and avoid paying the victims their full court awards, as well as to stay discovery in additional civil cases underway by Attorney John Manly, who was the attorney in the recent $3.75M award case.

Of course Bishop Stephen E. Blaire positions the news as if he truly wants to "fulfill the responsibilities it has to victims of sexual abuse, particularly those who have not yet had their day in court" but anyone reading the article with an ounce of intelligence will begin to understand the real reasons, as Blaire goes on to tally all of the church assets that are immune from the lawsuits, as they have been protected by incorporating separately, assuring compartmentalization of damage. But Blaire flat out states that "we believe that filing for Chapter 11 bankruptcy protection is the only way the Diocese of Stockton can continue [...]"

According to Lodinews.com Blaire states that "We can never forget that these evil acts [he doesn't even have the balls to blame their employees; the evil "Priests"], not the victims of the abuse, are responsible for the financial difficulties we now face" but then he glosses over the fact that justified court awards will probably be drastically reduced in the "fair" Chapter 11 process, saying that "Victims of sexual abuse will be represented in this process intended to result in fair compensation of all of these individuals. If we did not file, any remaining funds available to victims would likely be consumed in the next case, leaving nothing for those claims that have not yet been resolved."

While it would be lousy to be the 5th or 10th victim down the line, and sue, but get nothing because there was no Diocese left, I feel that that's exactly how it should go -- This Diocese has exhibited nothing but gross negligence over the past decades (to the tune of more than $35 million in sexual abuse damage claims) and they should be forced to sell off buildings, furnishings, properties, pensions, insurance polices, controlling party assets, and all other assets until they completely cease to exist. This kind of negligence does not deserve the mercy of the bankruptcy court, and I, for one, hope that they are denied bankruptcy.

More insidiously, however is that the actions by Bishop Blaire, et al, are designed to block discovery in other civil actions, as Chapter 11 automatically stays all discovery in civil cases. Attorney John Manly is more blatent in his criticism of Blair, saying that "There are really two perpetrators in every case involving Fr. Michael Kelly. There is Fr. Kelly and the Bishops of Stockton, including Roger Mahony and Bishop Stephen Blaire, who protected him.

Yesterday, a Grand Jury convened by the Calaveras County District Attorney's Office indicted Diocese of Stockton Priest Fr. Michael Kelly, on numerous criminal counts related to brutal childhood sexual abuse in the year 2000 while serving as the Pastor of St. Andreas Parish in the Diocese of Stockton.

Fr. Kelly absconded to Ireland in 2012, in the middle of a child molestation trial being prosecuted by this firm on behalf of another Kelly victim, only days after he was unanimously found by a jury to have raped and molested our client, a highly decorated Air Force Officer, when he was in 4th grade at Annunciation School in Stockton.  Kelly is known to be in Ireland, but guards his location and has repeatedly taken steps to avoid service of process.

Our firm, and our clients, are gratified by this indictment, and are very grateful to the Grand Jury and law enforcement officials in Calaveras County who worked tirelessly for justice on behalf of the victim in the indictment and the numerous other victims of Fr. Kelly.

Today, we call on Bishop Blaire, the Diocese of Stockton, and Monsignor Richard Ryan, the Vicar General of the Diocese of Stockton, a seminary classmate and lifelong friend of Michael Kelly, to disclose Kelly's whereabouts to the Calaveras County Sheriff's Office.  Moreover, we call on the Holy See and the Irish Bishops to effectively issue a clerical "all point's bulletin" to all Dioceses and Parishes in Ireland requiring the clergy there disclose Kelly's whereabouts to US law enforcement officials immediately.  We believe Kelly is being protected by clergy in Ireland and his whereabouts are known to them.

There are really two perpetrators in every case involving Fr. Michael Kelly.  There is Fr. Kelly and the Bishops of Stockton, including Roger Mahony and Bishop Stephen Blaire, who protected him.  Indeed, Bishop Blaire and Monsignor Ryan's depositions are scheduled for next week.  We learned on the day Fr. Kelly was indicted that they now plan to file bankruptcy only days before their depositions are scheduled.  The bankruptcy filing automatically stays discovery in a civil case.  It is clear that the Diocese is filing bankruptcy not because it does not have the money to pay a judgment or settlement in the three cases pending against it, but rather, to prevent the truth about the complicity of Bishop Blaire and Monsignor Ryan and other Diocese's members in Kelly's crimes.  It is a misuse of the process and cowardly.
